Yes you will need to be ready and having a supportive family behind you will help. Get your timeline done, anything that will help your defence make sure solicitor and barrister have everything. You can get through this. Remember you have done nothing wrong and it will be your chance to prove it. FA wont have even been challenged yet just blindly beleived. Court process wasnt as bad as we feared, as someones already said its like an exam and you must pass it. So be prepared and take all the advice and strength from all,of us been through or going through it. You can come out the other side x

      • My trial is in 4 weeks !!!!!

Hi all just having a panic attack my trail is 4 weeks and still the police / CPS haven't given my solicitor key evidence such as the CCTV and my FA medical notes there is a lot of other things too this has been requested now for over 3 months and nothing not even a reply to say it's being dealt with.

Anyone else experienced this ? Is it all tactics from the CPS / police ?

        Thanks as always

        • 4 weeks to,trial

          Hi there
You Must be feeling really worried. OHs trial,at the 4 weeks stage was when it really hits home. 'Its here'. We had disclosure right up,to week before trial. We actually had some late disclosure re a witness for CPS right at the last minute which greatly assisted his case. Actually also late disclosure during trial as CPS made further enquiries following our defence evidence and judge allowed this in, although it didnt do them any favours, it could actually be shown to be unreliable and factually incorrect.
Some of Fa medical notes were missing, so,you wont necessarily get all the medical notes. I Hope you and your defence team are as prepared as you can be, it is crucial you scrutinise CPS paperwork for all inconsistencies, especially if you can find fact to disprove FA lies. OH had meetings with solicitor and Barrister during the last month and this was extremely useful, a lote of defence was pulled together in last month, happy to help or chat if feel,it might help. Try not to worry and take it one day at a time, hard as this is just get yourself ready. Its when it gets to,court that you will get your say, remember FA hasnt even been doubted or questioned yet , just has her word taken as read. Your solicitor should be chasing CPS for any O/S disclosure from CPS. Sending Positive energy to you

          • Three days before our original trial date (Nov 14) another allegation appeared which had been made a year earlier (Nov 13). We knew nothing about this, it's as though the police had hidden it as a surprise at the last minute, making it difficult for OH to defend. There was another statement from one of the accusers which they refused to hand over. Basically the ring leader had claimed the offences had taken place against 5 of them but when interviewed one kis said no, nothing had happened to anybody. We finally got that statement within a few days of the actual trial. In the end there was no fiscal assigned to the prosecution and it was postponed until Jan 2015.

They make it up as they go along I'm sure.

For instance, OH was charged with showing 15 year old a pornographic image of a naked woman with large boobs. This pic was apparently on my OH's laptop's favourites bar. Forensics never found it, wtnesses didn't turn up in court yet charge remained. It's all sh**.

Sorry for ramble- feeling angry today!!!
They tried to bury us- they didn't know we were seeds

Thank you so much for the advise and the information about your case your right it's massively hit home now mixed emotions from absolute dread if I'm not believed I go to prison for many years or on the other hand this 17 month ordeal comes to an end !!

I've had a email from my sol today saying the CCTV has now been received and I'm due to watch it tommorow apparently in one of the bars you can clearly see me and the FA kissing and holding hands neither of us are unsteady on our feet. The CPS are also saying that her previous false allegations are irrelevant as is her medical history and that her working as an escourt has no relevance to the case ? If think it has every relevance am I wrong ?

              • Stay strong

Exact same emotions we had. Its just awful but staystrong you can get through this. OH also knew its the difference between a jury seeing through the FA lies or as you say sent to prison for a long time But keep faith. The CCTV sounds promising. I have to,say not everything you expect is counted as admissable. FA and sone of her witnesses all,had convictions for dishonesty but none of that was allowed in. It was very important in OH case that solicitor and barrister in particular got all our defence material agreed with CPS once we were at court right at start. Also barrister drew out a lot from FA during questioning her and also a couple of people she got to back her up to,show collusion and lies. So keep, positive, dont be afraid to,put any ideas or thoughts to your solicitor and barrister. I did and some of it was used at trial including facebook and photos which helped greatly. keep going, hope the CCTV you view will give you some strength and confidence

                • From our own experience and reading about the experience of others. CPS tend to try to keep as much information to themselves if it hinders the prosecution. This is where your solicitor steps in to ensure that all info is disclosed. Our sol repeatedly requested all info and it was not sent. It gradually came in once our sol had threatened to take them to court to force them to provide it. It is amazing how much CPS classify as 'Does not assist the prosecution' and then fail to provide it for the defence.

We also found it useless to examine the 'log' of all the investigations. (I can't remember what it was called). It could show up records of speaking to witnesses which may then establish what information the police/CPS hold.

We found that in the last perhaps 2 weeks, things increased in pace. However, I know that sometimes evidence can be presented even nearer to the trial date than this. It speaks volumes.

Best Wishes - I hope the CCTV assists you and that the truth will be clearly revealed.

Thank you for the reply I've also learnt that her previous accusation was NFA Because there could find the accused ???? Do you think as I do I was revenge ? Is that worth discussing with my solicitor tomorrow?

                    • Definitely

                      Hi yes

Definitely, you must discuss everything with solicitor, write it down as well so,solicitor takes it on board. I think I was a bit of a nightmare with writing everything down to make sure solicitor had all facts. Its your life, the smallest of detials can be crucial, the barrister must have all the facts, i constanly emailed details. Especially if shes done this before, as our barrister said Devil,is in the detail and that was true. The detail was with OH and defence not the CPS.
