      Remember pas can be that they are telling him something that didn't happen, or that your stepson is very hurt by not being able to see you and maybe trying to get back at u

        Good morning in relation to my case can I sue the cps and also the police for a breach of my human
        rights for example and am I able to get legal aid to fund it ?????

          No you won't get legal aid.

          What argument would you use to sue them? An allegation has been made. The police have to 'investigate' it. CPS give a decision once they've been sent the file and looked through it.

          What human rights have they breached, that is illegal?

            ok I have never thought of it like that so why now ??? and I genuinely believe that this a ruse to get me out of the picture so that her new husband can adopt my children .also can I sue cps and my accuser and get legal aid to do so my solicitor says no I cannot !!!!!!!!!!!!!!!!!!!!!

                I've answered that above. Asking the same question won't produce the answer you want. Well it might, but you'll be disappointed when you try.

                Which Article of HRA would you use, in your attempt to sue?

                Immigrants use the HRA to allow them to stay in the country because they have family here. Does that apply to you?

                  Re going through hell !!!!

                  I do not know I just thought that maybe it would be a breach of my human rights others bang that drum so I thought that maybe it applies to other cases at the end of the day all who are on this forum have been wronged and put through the ringer why does our justice system and our government protect those that have quite obviously hidden behind a screen that is human rights !!!!!!

                    Somebody makes an allegation. The police have to investigate it. This means either inviting a person for interview or arresting them and interviewing them. Sometimes that means the suspect is locked in a cell for a certain amount of time until an interview can be held. It's not false imprisonment as some people seem to think - it's the procedure.

                    Because a suspect says "I haven't done it" doesn't make it true - hence everyone is treated the same, in that situation.

                    The police then have to "investigate" (some do and some only investigate evidence that might help to push it to a charge) and that takes time. It's procedure and not breaching any HR.

                    They then send the case to the relevant CPS who then look at the "evidence". This takes time. It's procedure and not a breach of HR

                    Sometimes the CPS take a few weeks to NFA or charge, sometimes it can take months or over a year - as members on here can testify to.

                    Freddie Starr was on bail for 19 months (I believe) and was then NFA'd. He was rightly angry that it took so long.

                    The problem is, we now have what is known as "the Savile Effect" - whereby hundreds more allegations are made per year than there used to be - it is no coincidence that this has something to do with the fact that "compensation" is shouted from the rooftops in most newspapers and also the lurid details being put into the media so potential false accusers can pick up on the "similar facts" and make the same allegations.

                    The police and CPS are now swamped with such cases. This is why they take so long to proceed with in many cases.

                    Maybe if financial compensation was substituted with top notch therapy for genuine victims, and maybe if all the details weren't put into the media so people can make use of them to make their own allegations, and maybe if the police properly investigated BOTH sides, instead of ignoring what a suspect tells them then maybe, just maybe allegations would drop like a brick in a bucket (no financial incentive) as they did in Germany years ago, and also remove rape/sex offence convictions from targets - we might see a fairer system.

                    Until then we are stuck with what we have.

                    A statute of limitations (say allegations can be made from 10 years before maximum) would help of course.

                    Until the laws change in relation to these cases this will continue.

                      I do appreciate all your replies to my post and I am glad that I am actually getting comments that make sense ,I do appreciate everything that you say and I do take notice of them .in response to your latest post it is just sheer frustration that I continue to question what is happening to me not to mention the countless number of others that are going through the same thing or worse .once again I thank you all !!!!!!!
