  • I dont even understand how this is happening

    Hi all,

I just had to speak out about this I'm so irate! I went out a couple of weeks ago for a few drinks, met a lady, walked her back to hers, we engaged in consensual sex, then apparently 4 days later she called the police and said I raped her, it's ruining my life i don't know what to do, I was arrested a couple of evenings ago interviewed now i'm on bail, her story doesn't make sense and has so many holes in it, everyone who knows her side can see even without my side of the story its illogical but im still here waiting, it's killing me and making me very depressed. Someone please help me!

Sorry that you had to find this place my friend but you are among people who understand.

There will be many along very soon who will be able to give sound advice on your next steps.

In the mean time please do read through the forum but do not get too alarmed about what you read, if your situation is as you say you should be OK (and I am not doubting you for one moment), but it may well be a while before this is all over.

A good solicitor will is of your most urgent necessities.
    Still here

Thank you, I have been reading through the forum, and it heartens me (that sounds bad) that i'm not alone, i'm just scared, i have no solicitor or legal defence and i wouldn't know how to go about acquiring one, I have no money, nor savings, do i just call up a local one and tell them what I've been arrested for and see if they can help?

In the first instance try and find a local solicitor that specialises in this type of case.
Not a general law one as they will be of no use.

Jordans Solicitors are good at this kind of thing see if there is one near you.
See if you can get a free 30 min session and see where you go from there in regards to legal aid.

Not much will happen at the moment it will be a waiting game so try and stay calm.
Do you have any text or social media contact with her? if so keep it safe.

We don't know where the OP is from at the moment, do we? Jordan's may not be the best sols for them if they are at the other end of the country. Plus of course, if sols are busy giving free interviews on the phone or in meetings, then they won't have to time to be doing trial and appeal work. It really depends on what any solicitor is doing at any one time. Some sols will give free advice if they happen to have the spare time.

Were you interviewed CG? if so hopefully you had a solicitor present.

At the moment unless you can pay (or you can find a solicitor who has time to advise you for free) there is not a fat lot anybody can do, because disclosure/paperwork doesn't trickle through until after charge - and of course you may not be charged at all.

In some situations a solicitor can advise you as to what to say/hand over next time you are called in for interview, (or before) but that is not something that happens often. It really depends on the evidence you have to disprove the allegations. If the evidence you have can be twisted then best not to hand it over to the police. It has been the experience of some people where police officers have hidden evidence that could be helpful to the defence, or they re interview/visit the complainant who then changes their story to fit.

RF- I was interviewed and I was shellshocked at the time about the accusation and I know i'm innocent so I didn't have one.

Her story went like this: I stalked her home not talking to her once, pushed my way in through the doors, to her flats/apartment door, i went into the living room, she then went into the bathroom to change clothes, came out, when she came back i was doing various things completely out of character for myself, i then pushed her down on sofa, raped her for like a minute, then sat down on the floor, carried on doing something out of character then sat back on the sofa behind her and fell asleep, in the morning when i woke up i left. Thats her story, but i know its completely different. I don't know where I stand in the slightest in all this.

Indigo- We'd never met before so I have no text/social media contact.

Now that's an interesting one... in my going out days, had someone stalked me and pushed their way through my door, my first reaction wouldn't have been to go and get changed in the bathroom....

I'm sure you're going to find plenty of holes in her story. The general consensus is to keep the details to yourself and your legal team as the police sometimes present the accuser with your evidence, allowing them to change their story.

Although this is a huge worry, try to keep your life as 'normal' as possible.

WGO/RF- That is what my entire family and my best friend said they were like "why the hell would you do that?" plus my thoughts were on a Saturday night police presence in town is very high profile I would have thought she would have at least made an effort to get their attention/ if not any other human beings.

It's hard to keep my life normal, when my family found out my sister broke down in tears at her work, her manager called my manager (we work for the same business chain) and told him and he told my entire store, they're all acting like i have chains around my ankles and wrists already, even my friends at work won't talk to me any more, it's taking almost all my self control to not do anything stupid :'(

He's not allowed to do that - he's breached certain data protection rules - a sackable offence I believe. Is it worth you having a word with the top management of the chain? Possibly they could move you to another branch until this is over.

If your friends at work won't talk to you, they were never your friends to begin with.

Rules are incredibly lax as it is so he'll just deny it and so on. Every store in the city knew about it in a day. True, but it doesn't make going in any easier. Reading posts of similar situation here terrifies me, I can't live with this shadow hanging over my head for months to years.
