    Rather ironic but I found this site after my son was recently acquitted after being falsely accused of rape. i was looking for other such cases and how to deal with the aftermath. It is heartening to find so many survivors but my heart goes out to the many who are going through this terrible nightmare.

    Some of the high points and low points of my son's case which might be of interest to others depending on their current stage of the journey:

    High points:

    The jury were fantastic and ignored the biased summing up by the judge

    The jury took just 90 minutes to find him not guilty

    The prosecution barrister did not give him a hard time (our barrister said he was sure the prosecution didn't believe her)

    The medical expert from the rape centre who examined her was very fair and refused to be bullied into saying things that would have supported rape

    There was a gruesome and bizarre murder case being tried at the same time and that took most of the media interest leaving our courtroom devoid of journalists

    Low points:

    It took 3 years to come to court (his solicitor had closed the file as he thought it was definitely NFA)

    My son stuck with the duty solicitor from his arrest and he kept telling him nothing would come of this. I doubt he had much experience of this type of case.

    The police refused him legal representation at his initial interview. Before trial an independent judge rule the interview inadmissible.

    After two years of nothing and despite an agreement that they would contact the solicitor if they wanted to question or charge him, the police arrived early one morning with journalists and a film crew from local tv station to arrest and charge him. The police had been criticised by a report on the local tv station saying they weren't doing enough about rape allegations. This was their attempt to show they were. So they took along the tv crew and arrested a number of men involved in ongoing allegations.

    She changed her story 5 times and the police accepted each different version without question

    Previous false allegations she had made of other rapes and assaults were not allowed to be mentioned in court

    Her drug and alcohol addictions and mental health issues could not be raised despite playing a big part in her false accusation

    My advice to others is this:

    Never trust the police. They are only out to get their conviction rate up/next promotion.

    Find a good solicitor who has the right experience. He will find the right barrister.

    Get your phone/laptop to your solicitor for him/her to get it forensically analysed for all texts/emails etc. if they support your defence. These were absolutely crucial in my son's not guilty verdict. The jury were actually shaking their heads in disbelief at some of her messages to him begging him for sex after the alleged rape.

    Have faith that the jury might be decent people who will see the truth despite the attempts of the prosecution and the judge to force a guilty verdict.

    The "victim" told my son that she had tried to withdraw the allegation several times but the police threatened her with prosecution and a jail sentence. And she was told in detail about the compensation she could claim if she went through with it.

    Hi, thank you for posting your experience up and I'm sorry that it took so long to get the right result. You have made a lot of valid points that will help our members, so thank you for that.

    And God promised men that good and obedient wives would be found in all corners of the world. Then made the world round .... and laughed and laughed and laughed ..

        I'm so glad to hear your son's 3 year ordeal is finally over and you can begin to live again. It is really kind of you to post your experience on here but it makes my blood boil to think of what your son has been through when it could have been sorted at the start.
        Any previous FAs should be declared at the very least but well done to that jury.
        The money wasted on these trials that could be better spent on pensioners or disabled must be a tidy sum. The police should be brought to book for not allowing a retraction of what was obviously an FA.

          Thank you HTW for your helpful information. Could I please ask you some questions......... Why were these issues not allowed to be raised? And did your barrister/sol fight against this?

          At what stage did you find out the information that the 'victim' had tried to withdraw her allegation?

            She had told my son when they met that she had previously been raped by two members of her family but his legal team couldn't find anything relating to this. She once reported my son to the police as having assaulted her but the police doctor said her claims were false as the bruises she claimed were fresh were days old and inconsistent with the claimed assault. The police asked him if he wanted her charged with false allegations and he (the loved up idiot) said no as it was down to her mental health problems. Oh how he later wished that he had.

            Yes, the barrister/sol wanted to use this at the trial but on the first day in court when it was just the legal teams agreeing "stuff" with the judge they tried again to get it included and he ruled that they couldn't. (It was only a half day as the judge had another appointment. So it was selecting jury etc)

            His legal team were exasperated but I do have to say they were so respectful of the judge and lacking in force that I got rather frustrated. At one point I was asked to leave the court and only allowed back in once I agreed to respect court etiquette.

                Sorry I didn't answer your question re "withdrawing her allegation" .

                She told my son early on that she had tried to withdraw it. However, she was and is a compulsive liar so who knows if that is true. What it did do (at the time) was soften his view of her and he stayed in text and email contact with her which, ironically, helped him when it went to court and all of her requests for sex (post "rape") were shown to the jury.

                  Thanks for your kind words. I'm not sure you can ever recover from this. As a parent it is one of the worst nightmares. You tell as few people as possible to avoid the usual judging and "no smoke without fire" comments. Everyone's health suffers. My son still cannot sleep at night and gets anxiety attacks. I feel it has taken years off all lives. My son lost his job due to stress and is unemployed. If he applies for a job and it requires an enhanced CRB I believe it will show his arrest for rape and the acquittal. That will still put off employers. He is now getting counselling and I think it will take a long time before he will ever trust a girl again.

                  That said, we are one of the lucky ones and my heart bleeds for those of you who have loved ones incarcerated by the lies of evil women.
