Confused and left alone - How can I help him from abroad?

    Your friend should ask his criminal defence solicitor these questions. Nobody on here can possibly know the answer as each case is different. Some people are remanded into custody after being charged and some are not.

      hi when he goes to the police on the date he may find he is just re-bailed and no decision has been made. Has his case been passed on to CPS yet these are the ones who decide to charge or not. the best thing to do is get his solicitor to call and see if they can get any info before his date as no one can say if he would be kept on remand or not.

          update

          just wanted to keep you updated, he has been rebailed next bail date is thursday. I have been told that if the police plan to keep him in remand they would tell his solicitor two days before. As we havent heard anything from him i keep telling myself no news is good news. if they keep him in remand I wont be able to see him again until after he had his trial and thats a thought i cant bear. Ive visited him for two weeks but since ive left we've both been very stressed. I try to calm him and distract his mind but i dont think its working well. however if he gets a NFA or if hes going to be on bail i will move to england and live with him until his trial or until i can continue my education. at least thats something to look forward to

              No-one can really answer that question with a yes or no but as the original purpose of bail was to make 'further inquiries' i.e look for sufficient evidence to charge, then the rebail suggests they not found any!

                charged

                received a call from the police this morning saying that they are going to charge him in two weeks. I am very devastated at the moment, and so is he. This will make it even harder to find a flat in a decent neighbourhood

                However there is one good news:
                The baby was born few weeks ago, healthy and strong, and he was able to celebrate with his family a few days ago.

                  He said his police station representative bavk then was a tainee solicitor who had told him "no comment" would make things worse for him and he should talk to them. Are trainees really allowed to represent him there?

                    My understanding is that a police station representative is a particular qualification within the profession, much like a GP within the medical profession, so maybe he meant that he was hoping to become a specialist solicitor in one particular aspect of law.

                    Do not worry unduly about the advice that was given at the time, this will have been based on the basic facts then available.

                      As long as they are "Police Station "Accredited" they can undertake police interviews

                        thirteen months later...

                        Not guilty!

                        We just heart the not guilty verdict and didnt have to go through the trial process. Thank god knows am so relieved. Mire details later

                                Thanks everyone for the bananas!

                                So ill just make it as short as possible:
                                Trial was due to start on tue. 10th and it really wasnt looking good for us and we were preparing everything for a guilty verdict and a sentence of about 16 years. It was looking very bad for us and I think even our solicitor and barrister knew that chances would be a 75% conviction.

                                One week before trial the accuser, F., was shiwn around the court premises and told she can have a veil or video evidence if she wanted. She is the accused man's daughter and had left the family home at the time of his arrest one year ago. She since lived with foster people who couldn't handle her anymore and were giving her an ultimatum to move out after trial. So she became a nervous wreck the weel before trial and her mother had to pick her up from the surgery as her gp wouldn't leave her alone. She since asked her mum to be alloeed bavk in home and moved back in even though the other siblings did not want her there.

                                There was a lot if crying amd suicide attempts and she told her mother she never thought this tiny lie would grow so big, she regretted it and wanted to set things right. She disclosed that she onve had told her friends shed been abused by her d ad, they told her teacher and her teacher had a talk with her. In this conversation she repeatedly admitted she made it all up but the teacher (social work and health care) still got the police and social services involved. So things proceeded and she felt she couldn't back out anymore. She never thought It'd go so far...
                                However she then went to the police on sun. 8th and admitted she had been lying. Our trial got postponed to Wednesday and finally Thursday when tge cps asked us to come in for mention. They then announced that "after careful investigatuon" they found the accuser had been lying (WTF) and they were going to drop the case and we automatically were given a not guilty. The reason they decided to drop it was bevause they put the girl F. Under pressure saying if she doesn't snt want to attend court they would get a court order and keep her in remand until trial. Bare in mind they were talking to a 19 year old girl with mental health issues and five attempted suicides since the investigation started. F. Scared to death overdosed at 3am on monday amd was admitted to hospital, and was released the following day. Doesnt look hood in the eyes of a jury. So they dropped it and we got our not guilty the very last minute.


                                We were very lucky because otherwise we would have heard a guilty verdict already and be separated for at least 8 years. We will now make plans for the future and get married soon. This would have been gerrys first case lost I think and I m so glad we didn't ruin his statistic

                                Id like to thank our barrister ms. DALY who was absolutely brilliant, a tough nobull**** lady and very straightforward. Also gerry MCDONALD and SANAH from ebr attrifge who have taken a lot of time preparing us for the trial amd possible consequences. Sanah was brilliant and always there whem we needed her, and gerry was so relaxed and honest we felt absolutely safe all the time. Thanks a lot to our defence team.
