  • Confused, angry & emotional...

Hey guys, I'm new to the forum and just looking for some help/advice in regards to a recent incident

My name's Tom, I'm a 22 year old student. I was woken up by a couple of police officers knocking on my door yesterday (Tuesday), they arrested me straight away after an allegation of rape was made. They took my phone, loads of my clothes and humiliated me in front of family, neighbours etc.

My shoes, hoody and belongings were taken and I was thrown into a freezing cold cell for hours until they took me into an interview room and treated me like a criminal (seemed like they were trying to make me trip up, catch me out in a way). She told the police she remembers kissing me and leaving the car but can't remember anything from that point onwards.

Me and my mate were out driving around on Saturday night, we met up with this girl I know and chilled out for a bit. We had a smoke and they had a small drink of cider (nowhere near enough to not know what she was doing). A little while later she leant over and kissed me, we left the car with each other and began to have sex, I asked if she wanted to and she was very much up for it. Afterwards we got into the car and carried on laughing and joking like nothing was wrong. I dropped her home around 30 mins later and didn't think anything of it.

I have no idea why she would make this up, I found out on friday that my mums father-in-law had been abusing my little sister and cousins when they were younger and this is the last thing I need to deal with at the moment.

Any help or advise would be greatly appreciated!

Hi Tim, stay strong you will need it. This may go on for some time where you may be re-bailed' my son was re-bailed 5 times. It may be dropped by the police if they do not have enough evidence, if not you will be re-bailed to wait for a decision from CPS. Do not talk to the friendly policeman/woman about the allegation, let your solicitor do that. Get the best solicitor one what deals in serious crime like rape, check out the solicitor thread. Legal aid you can still get,but this changes in April. I have a good one for my son from this site. Think about the motivations why she would say such a nasty thing and write it down. Take a copy and screen save everything what may help your case from her Facebook/twitter etc, and do not communicate anything about this on yours. Write down now every tiny detail about the event and keep it in a safe place. Take care and stay strong, we are all in the same net as you and this government don,'t care as long as they get their vote from the vast amount of people in this country that don,t know what is going on.

Thank you so much for the kind words, yeah I guess your right about it taking time. I was just interrogated the whole time by people who were 'there to help me' and incredibly shook up over the whole thing. I don't have a vast amount of money spare at the moment which is preventing me getting a decent solicitor.

But I'll take your advice on board and document everything!

      Thanks again, Tom

This is somewhat ironic as you will therefore understand that the allegation against you will be thoroughly investigated; after you wouldn't want the police to start their investigation against FiL with the assumption that he may be innocent.

Sadly for you, in sexual offence cases, the old premise of 'innocent till proven guilty' flies out of the window and Mumpleasehelpme has given excellent advice regarding preparing a defence.
