  • Advice needed please!!

    This is my first post any help would be welcome, my boyfriend has been convicted of rape, there are numerous issues with this so we are currently in the process of trying to appeal. I was wandering if anyone could recommend any good appeal solicitors, how long CCTV footage is stored for and where it is stored. Just any help in general that would help would be most welcome!

          If you find CCTV that was available at trial but not used or obtained CA would ask why not? If there is no good reason they wouldn't accept it as fresh evidence.

          What does trial counsel and sol say about appealing?

            Chris Saltrese is recommended by many as an expert on appeals - he does Legal Aid work and works nationally. also you can look here...

              To Rights fighter,

              Some CCTV footage was shown at his trial, but they did not really show anything either way from what his solicitor told me. The police did not collect the important tapes/ did not disclose the actual important parts.

              His trial barrister said that there would be no chance of appeal, I am currently waiting for his solicitor to send me what his barrister actually said to him.

              If CCTV wasn't shown and there is no good/valid reason would this be in his favor?

                  The barrister should write a document called an Advice on Appeal - even if it is negative. That would help any fresh solicitor.

                  I work for Chris Saltrese. Check out the link on my signature. MH attended a trial where Chris was lead solicitor (although not present) and our QC Tania Griffiths defended. We got our not guilty verdicts.

                  If fresh CCTV or if the police withheld useful bits then that might be used at appeal. Without knowing anything about the case and not having seen any paperwork nobody can say at this stage.

                    Not me personally (I'm still waiting) - but I attended billykickass's trial to support his gf and their families. barrister Tania was outstanding and Harry the sol who was there was excellent too. If I ever need a defence team, that's who I'll have...

                          If you check out the link in my signature you will see he is in Southport although they do have an office in Telford too.

                          An appeal solicitor should request all paperwork pertaining to the trial that is 'disclosable'. Some police and prosecution barristers withhold disclosable material so it's up to you to tell the sol what you know and them to try to get it.

                              Is the accuser on Facebook? Can you see their profile? Do you know of any witnesses who could help who were not available at the time of the trial for any reason?
