Hi my dad is a carer and lives in flats that have people with disabilities as well people without disabilities, my dad is one of those people who cant be rude at all, and two women with disabilities starting going round the flat to where my dad and mum live, they come in as dad used to leave door open for the cat as he is bottom floor flat, after a while they was coming over regular and my dad and mum would make them a cuppa as they are too friendly well they used to come around alot and used the cat as a excuse to come round, my mum thought that it was getting too much so they started to lock the door and because they was stopped from coming round (locked door) a week later after the door locking the police come to my dads door and arrested him for accusations of rape and sexual assault :O He was released on bail for 3 months and is due to go back this week to find out what is happening, he is really worried he will be charged for it due to them having disabilites that they will be believed, He was accused of raping one and sexually assaulting the other i am not sure if they did it for payback or what and with it being in the press so much lately about rape! Can anyone help me with advice as we havent ever been in this position before

Hi worried and welcome to the forum - I am so sorry you have had to find us...
From what you say, revenge does seem to be a motivation here... I am assuming he was interviewed under caution? If so he now needs to find a solicitor who specialises in False allegations of sexual assault. In the meantime, ask him to write down everything he can remember about any contact he has had with these 2 people - especially if the police told him times and places. If he is on FB have a look at their FB pages to see what they are posting and screenshot anything and everything that could help and save it somewhere electronically. Make sure he doesn't say anything to the police without a solicitor present and to only answer questions they ask and not volunteer any other info even if he thinks it'll help him. The police have conviction targets to meet and can use underhand tactics to get these....

He may well be eligible for legal aid if it comes to charge. I know the perfect barrister if he should be charged. He will know the right solicitors to instruct.
When he starts talking about doing away with himself maybe you could say that the media would say that 'he couldn't live with the guilt' and he needs to be here to clear his name.

Hi,
I'm really sorry that they have put you and your father through this awful situation. It might be best using the time till his re-bail to do a bit of digging. Is there anyone who could have put them up to it such as a family member or support worker? what was their reputation in the local neighbourhood? It might be work speaking to some of the local neighbours as you might uncover some stories about them. As they truly sound a dodgy pair.

the only case i have read on here is from stressed and he is now locked up, it really worries me, do they lock people up when they innocent, just i thought that lad was innocent yet now in jail, i cant have this happen to my dad as he hasnt done a thing but i am not confident with the law and worried they put innocent in jail

The cases are not similar; SO's thread is rather long and complicated to read through in it's entirety but basically the lad who was actually accused of raping the girl (SO's 'friend') changed his statement from originally denying being at the scene at all to saying that he was there but didn't continue with intercourse when he realised she was underage.
We haven't heard what the verdict was for this lad but I fear SO (who told us he only drove the car) was tainted in the jury's collective mind by association.
In your dad's case in your OP you said "my dad and mum would make them a cuppa as they are too friendly" so I'm guessing that they must have said that they also came round when he was on his own? I realise they have not given specific dates but this will tell against them if your mum was mostly there when they called.
Should it go any further your mum will be a vital witness in his defence.'What doesn't kill you makes you stronger'

because these women have disabilities which is learning, and there is two of them (best friends) is it quite likely that my dad will go down for it even though he hasnt done a thing, as i wonder because they have disabilities they will more be taken on their word even though made up

The CPS will make their decision as whether to charge or not based on the likelihood of getting the conviction and of course they may well take the view that these women for various reasons (and not necessarily due to their learning disabilities) are not reliable witnesses.'What doesn't kill you makes you stronger'
