    hi all,

    I have just been charged with 13 counts of rape against my ex partner!!!!!! after a 2 and a half year court battle for contacted with my son witch in the end went my way. I now find myself wiv this to deal wiv. she also made allegations that I heard hurt my son that was nfa after I could prove that my son came to me with the marks. so she has been caught out lying 1s with this. so why have they pressed charges!!!! ggrrrr please can some 1 help even her own family are on my side!

        Cops are not stupid, they are cunning.. And I learnt the hard way...

        My advice is to find a good solicitor, deep breath.... And take one hurdle at a time.

        I have wrote down a couple of a4 sheets of question ready for my meeting, this ensures I have covered the majority of what I need to ask..

          well she has been caught out lying about my son to the police.

          she has also been caught lying in court about things to do with my son.

          i just don't know wot to do

            Hi OMG

            Sorry you find yourself here. You need to find a solicitor that specialises in these matters, if you post up your county someone maybe able to recommend one that is local to you.

            Your story is unfortunately quite common on this forum, it maybe worth looking at ghost biscuits' thread, he hasn't been charged but is compiling evidence should it come to that.

            I get the impression you are very shocked that the charges have been brought, once that subsides you need to do your utmost to build your defence hilighting her motive for making a false allegation and as you have already stated her lack of credibility due to previous allegations that have proved false.

            Did you have a solicitor with you when you were first questioned ?

              Hi and welcome though so sorry you have had to find us....

              First - do not share anything with the police that will help you at this stage - save it for later....if you give it to them now, they will go back to her and she will change her story to fit, or they will lose it.
              Get a GOOD solicitor and don't speak to plod without him/her present
              Document as much detail as you can remember about absolutely everything that has happened between you and your ex to do with lying, custody, etc etc. Keep it somewhere where plod can't get it - USB stick hidden from them should they decide to take your laptop.
              Ditto text messages, social media etc etc. Screenshot any FB pages/messages and so on.
              Don't break your bail conditions
              ask her family what they are prepared to do to help you....

                i no y she has done it, some 1 made a call to social services saying the children were being left alone late at night (found out this from ss 3wks after i was arrested) 5 days later she goes in and makes these alligations.

                i had the duty brief the frist time i was interviewed

                    Which area in the UK are you living hon? Maybe there are some 'older' members in your area who could offer you one to one support. You seem to be struggling hugely.

                      pros case

                      hi all,

                      have had a copy of the prosecutions case, one statment from my fa and her husband his mum and his sister, to whom i have never meet and all that is in there statments is they heard shouting next door, o in case i havent said before the fa is my ex-partner and she was sleeping with the man nextdoor, we had been in court for 2 years about my son which went the way of my son for him to see his dad (me)! they have not put statments in from her own mum and nan that were round the house nearly everyday. the police didnt interveiw the people i asked them to speak to.
                      And to top it all off because my name went in the paper ss worker came round and said i was not allowed in the family home, i told him that i thought the law was incent untill proven guilty!!! Do they have the right to do this? this is not on my bail?

                          have had time to read though statements my fa new husband who she was having an affair with is saying that they didn't get together until oct 2010, when me her own mum/step dad and nan no this not to be true, as soon as I left august 2010 they were together this is why she fell out with her own family.
                          any1 have any thoughts as I think this would blow a big hole in there statements, and a statement put in from her friend found me to be polite and friendly, and found her new husband to be controlling, also officer that interviewed her mum said she was on her own but have found out that her husband was in with her.

                            I guess you're wondering whether to pass this information on to the police/CPS so they will then discontinue the case against you. If you did they would certainly re-interview your accuser who may then come up with an convincing excuse for the 'mistake'.

                            If you keep this information between you and your defence team and the case goes to trial and your barrister cross-examines her about this discrepancy it may fluster her and show her up as an unconvincing witness to the jury.

                            It's really a judgement call as what to do for the best and you should discuss it with your solicitor, but most members, from experience, would never suggest sharing defence evidence with the police.

                              having just looked at her statement summary record it states that the rapes started after are son was born, on the police report it says they started when she was about 15-20 weeks pregnant, are they allowed to leave this off the summary record??

                              anyone have any idea
