  • To all those falsely accused of sex crimes

I have been to hell and back and to hell and back again.I have come to some very strong conclusions of how the system
works against those who are innocent and would like to offer some humble advice to all the poor unfortunates who find
    themself living in this nightmare.

1 Tell the police as little as possible and be very careful what you say everything will be recorded and twisted and distorted at the trial

2 The police believe you are as guilty as hell and are looking for some brownie points

3 The police will not try to establish your innocense only your gulit strong evidence for you show be only revealed to your legal team.

4 The police and CPS want to portray you as a violent controlling monster so stay calm and in your statement ensure you do not incriminate yourself. The police will try to get you say thing like you have a quick temper or prone to violent outburst etc etc stay calm deny any thing they can use to make you appear as a controlling person Three things the police and CPS are big on and build there cases around CONTROLLING ,VIOLENT GROOMING

5 Duty solicitors are no good search online for legal eagles who have experince in these trials reject any that are reccomended to you but have no experience in sexual cases

6 be aware that the CPS will use top people who specilise in rape crimes your barrister must be equal to them

7 Read the accusers and witness statements over and over again look for contradiction and weakness

8 get friends and family to try to remember dates and times many head are better than one and compile a dossier of these dates
use work records medical records photographs letters documents of any sort to support your aacount

9 The phone and PC are treasure troveas to the police if you have CP rape and bondage images or videos the CPS will use items like this to bolster their case against you .A man may look at legal forced sexual videos but would not actually really rape someone the CPS do not see it this way

10 Some questions the CPS in court will spring on you are why is the complainant lying what does she have to gain please do not say for the compensation
it sounds desperate and is difficult to prove

11 some where in all the madness there are weaknesses you have to find them and get your barrister to exploit them

12 Look at each member of the jury when you speak and keep eye contact with them throughout the trial it is those 12 people who will convict you or acquit you they are the one you must convince.Be strong under examination do not allow the prosecutor to bully you strongly dispute her aacount of events and if you are not too quick at thinking on your feet pause before answering. The prosecutor is looking to make you say something to support the victims account.

13 look at past cases and trails appeals try www.bailii.org/databases.html‎

14 have faith in your friends and family talk to them how you feel ask them to tell you how they feel it is not just you on trial your family are two

15 if you have children The SS will be involved they are worse than the police.SS is the right name.Your partner must not cry your innocense from the rooftops they will not believe her they will say she is in denial or worse she knew about the abuse .Best comments are to say we must see what the outcome is and try to stay away from opening defending the husband SS have you guilty and will do anything to break the family up.They can get away with anything in a family court which would be thrown out in a criminal court and they lie oh yes they are wicked liers.

16 if you are convicted have the grounds for an appeal if any sorted out before the trail ends look for legal slip ups by the judge although they are more careful now in their summing up.Getting an appeal is not automatic your barrister has to agree that you have grounds for an appeal and some may not support you you can appeal by other routes but appeals are har to get and very seldom successful

Finally you are in a fight for your life you have one chance put every living minute and breath into winning this fight tell your self you are going to fight like you have never fought before .You will be terrified you will be upset you will be angry that it has happened to you all this is normal the one thing you have going for you is you and the accuser knows the truth and no one else make the jury believe you or at least cast doubts on the accusers story
and the best of luck and your are in all our thoughts

Hi sadman - thanks so much for taking the time to post this valuable information and advice. It is a sad indictment on the justice system as it applies to sex offence allegations......

Absolutely perfect summing up and must've taken a great deal of thinking and time.

      Thank you.

Some very resonant points there, thank you on behalf of any newcomers.

In particular your summing up that the police are not to be trusted, ever.
        Still here

Some good points, but some that I disagree with.

Gerry McDonald is a duty solicitor, and he doesn't promote himself as a sex crime specialist, yet he is really good. http://www.ebrattridge.com/index.php...-mcdonald.html

I also dont think that looking the jury in the eye is always a good thing.

Also, why not tell the police everything if you have nothing to hide ? I think its horses for courses.

Every case is different, and you should listen to your legal advice before deciding what to do
