Hi, I am just wondering how this is justice, a friend of mine a few months ago was accused of raping a woman he knows well. Cutting the story short, he was arrested and the usual, but it turned out that the woman said she can't remember giving consent, can't remember even having sex or how she got to his house.
The actual story is this, group of guys and girls in a bar, drinking. My friend and this girl get close as a result of alcohol no doubt. no crime yet. then those two go back to his place and he starts the whole james brown music and low lights ****e. after a while he said they had sex and she fell asleep (after) he then slept on the couch and she left without saying goodbye. then a few days later he was arrested at work infront of about 30 of his close friends with a policeman saying "on suspicion of rape" quite loud.
now, this all went to court and she still couldn't remember anything. My friend was honest, really honest, and said yes they had sex, yes she was drunk, which was very honest. he also said how he slept on the couch was also drunk and can remember. the woman then said she can remember having sex (change of story) but not consenting.
Now i ask this, how did it get so far with no evidence, not a lack of evidence, non. i know they have to investigate a crime a bad as rape but surely they should need her to actualy say i didnt give consent or that she can even remember having sex, as far as she knew she woke up in a guy that she new very well flat and assumed not only sex, that she was raped. Now just to cover my arse, she does have every right to seek help and protection from the law.
But now some of my friend workers esp the women treat him differently, fair? no. he has lost friends, respect and is mentaly and physically effected by this. but to make him feel good the woman did say sorry or to quote "i'm really sorry what i put you thorough, but you can't blame me" nice.
I'm sorry if i sound angry but i am very stressed about this case, where is the line, who is responsable, how drunk is "too" drunk, does a woman need consent from a man?
