Yes I understand now, they want to give him an opportunity to reverse the no-comment interview rather than question him about fresh evidence.

Obviously it is best to follow the solicitor's advice regarding this on the 16th but I hope all goes well for him.

Seems his thoughts are that maybe they need to re-interview the girl in the morning so they have changed his Bail surrender time from the morning to the afternoon then has stated to re question him(has stated he was advised to say nothing) Spoke to him he is worried they might charge him, but bearing in mind the events in Manchester today with the Corrie Guy it shows that there is hope even if charged, the jury see through the evidence or lack off, guess the CPS & Police have to be really certain they can get a conviction and this and Jim Davidson must be causing the CPS some worries.how can they charge anyone just on the say so of one person without forensic evidence to back it up after all out of spite every MAN or WOMAN could find themselves in trouble.

For those that get found guilty and have to serve a sentence, when they get out.. they will be forever treading on egg shells..

update 8th oct

Hi well bit different story so update:
He now confirmed to his Girlfriend HE DID MEET HER but she never got into the car because he could see she was not 18 so he left!! not very happy with him because he lied to me after i gave him chance .
Interviewed by Police for 5 hours today, says they were getting nasty said pictures of girls on his pc were young girls(they were not he was single guy when he downloaded them! told him he was at risk to public if they released him? then threatend him they were now going to send papers to CPS and bailed him till January 2014!!!!? then allowed him to leave. seen this on TV were they threaten people to get them to confess to crimes they have not committed just to get him wound up so they say anything just to get out of there, myself still think they have nothing and this could have been their "last throw of the dice"(i hope) otherwise if they were going to send the papers to CPS they would have charged him?

Just as well that his first interview was 'no comment' then as it doesn't bode well to change your story halfway through the process (unless of course you are the accuser in which case it seems to be perfectly ok and no adverse inference is drawn)

The threat of 'sending papers to CPS' was an idle one, as you say just to put pressure on him, as the CPS are always consulted regarding any charging decisions where there is any doubt as to whether the offence occurred.

Of course if the pictures were young & unclothed, as in appear to be minors, then this is an offence in its own right and could well be prosecuted regardless of what happens in relation to the rape allegation.

Ok they interviewed him for 4 hours about his first statement, its identical to the girls until an alleged sex act was performed!!! when solicitor asked about The Rape Charges ? they the Police said "What Rape Charges " or suggestion that Rape occured !!!? it now seems from fresh information from his girlfriend that they questioned him for three more hours about the pictures on his laptop suggested they were underage he denied "here was no way according to him you can tell the age's, then they said they would send papers to CPS!! he has not been charged with any offence, they told him No DNA of the girl found on or in his car!! its her word against his they have everything texed from his her phones on the pc, when he was told he could go the told him "you are a danger to the public!"he is now making arrangements on adice from his solicitor who gave him the tele number to get councilling from an expert on these cases to defute the Police officers statement just in case .
Sorry to keep posting but it gives me hope and consolation has one of the the couple is close family member has the girlfriend

Ok an update
Today they have dropped the rape?
He is charged with sexual activity with a minor(he denies and will plead NOT GULTY)
MEETING THE GIRL,
Pictures of his phone
Moving video on external hard drive ? he has no idea.
He has to appear in Court to enter a plea in March, the solicitor said the case might not come up for a year to eighteen month's !!

THE BREIF told him she was going to take a close look at the charges has obviously the dropping of rape is a step in the right direction but guess you could say Rape and sexual activity with a minor( 14 years old,) is the same thing but its not is it?ACTIVITY CAN MEAN ANYTHING, maybe they are trying to make something stick however small! myself there is a difference between a paedophile and This Guy unfortunatly everything is being put under that Word, and there is a difference with someone who has been messing about with lots of minors ect over a long time or downloading images of small kids, one only has to walk in any Town/City Center at a weekend and see how these Girls are dressed and why are they dressed to look older and mature where are their parents letting their under age daughter go to town looking like an 18 year old !!When you look at the witch hunt ie DLT ect he is right things that were acceptable in the 60/70's and how do you prove an offence took place or in that fact how can you defend yourself it seems now all a female has to do is make an accusation and the Guy is Guilty .

thanks for the update - please tell your friend to be aware that they may try to persuade him to plead guilty tot he lesser charge to get a lesser sentence. if he is innocent, he MUST NOT do this. This cannot be retracted ever and there will be no chance of appeal.

I'm wondering what you're trying to emphasise with the quote below. Girls, women (or anyone for that matter) have every right to go out dressed as they want to as long as it's legal and in the social conventions of decency, without fear of assault or harm. It seems as though you are implying that because of the way they dress, the girls are somehow at fault - but I'm hoping that I am wrong in my assumption.

no my remarks are not has intended so it seems. i meant that dressing up to look older than you are is wrong and a person could get into a situation where the person he is with is a lot younger than she is or she said she was,and NO people who dress up are not asking for it !! hope you understand my meaning?

he will plead not guilty to the sexual activity, he cannot understand the moving pictures on external hard drive,they also charged him with Grooming.also pictures on his PC HE says she sent them but do's not think they are her!The Police told him if he pleads guilty to SA he will not get a custodial, but his solicitor is quiet bright, she has picked up the rape thing , the Police told him Rape was never mentioned !! but she has it on her notes.The Policewoman has been quiet nasty to his girlfriend " Oh your still with him then"? twice.

If they are trying to get him to plead guilty, they are obviously not certain about getting a conviction in court!

Glad he is not going to plead guilty as, even if the sentence is non-custodial, he will still go on the Sex Offenders Register and a member who had experience of this said it was worse than the sentence!
