NFA at last please some advice.

Hi all I have finaly been given the NFA after over 6 months of hell even though I have done nothing wrong.

I am picking up all my stuff later today and meeting with the police officer in charge next week as I want a restraining order taken out against my exe and for her to be charged with faulse aligations.

What I would like some advice on is my solicitor costs. The police would only corrispond through my solicitor thought the duration of my case. I was only ever arrested on susspicion and never charged with anything.

This has ended up with me paying almost £2000 pounds in solicitor costs which cant be fair as I was never charged.

Is there any way I can claim these costs back. any advice would be greatly appriciated.

PS With regard to your costs, I expect the police will be fire-proofed against a claim as you weren't ever charged & representation at police station prior to charge is covered by the duty solicitor scheme.

Has your ex-partner any substantial assets? If so consult a solicitor regarding a civil case against her for any losses you have incurred (however it is not a certainty that you will get your costs awarded even if the judgement is in your favour)

Unfortunately there is no such crime as making a false allegation. At best it would be PCJ (Perverting the Course of Justice) or wasting police time. Many have tried and failed because unless she admits to lying or there is incontrovertible proof she lied, you will be wasting your time. A civil suit could cost you thousands with no guarantee that you would succeed.

If you paid for the duty solicitor you might get some of that back from LSC (known as LAA from April). Contact LSC via their website and ask advice.

Are there any witnesses that your acuser told a different story to? Any text message email or facebook evidence? If so then get them to talk to police. It can be done but evidence is needed. You could file a harassment complaint especially if she has told other people the allegations and she will automatically be given a harssment warning. If you think the police have ignored or not collected enough evidence to show shes lying then file a report with the ipcc, they are surprisingly good at responding.

I will contact the LSC this week to see about claiming costs back fingers crossed on that one.

There is no evidence about the faulse rape claim however there is CCTV evidence and I have 20 witnesses to prove that she was lieing to the police about me being in her garden. The police told me they knew she was making it up and they would deal with her hence why she had to make the faulse rape aligation as her lies had been found out.
I am hoping to meet the officer this week to discuss as im very worried about what she will do next.
When I left her she told me that she will always love me and the only way she could stop was to get rid of me. She said she would have to kill me to get me out of her head.
I thaugh they were idle threats but seeing what she is capable of now im not so sure

For CRIMINAL MATTERS at Investigation stage with regards for getting re-imbursed the answer is no.

Advice & Assistance (aka legal representation) is FREE AT the Police Station. (even if your David Beckham)

Admittedly calls/letters sent afterwards aren't covered, but even at private rates its a heck of a lot.

Surley there must be some way I can claim back my fees?
The police refused to deal with me directly only through my solicitor.
I dont understand how this can be lawfull that I have to pay solicitors fees to corrispond with the police even when I was never charged with anything?
Any info the police wanted they asked my solicitor. who would ask me reply to police etc.

Let's clarify a couple of things.

Did you pay for the solicitor to attend the police interview?

if the answer is 'yes' why did you do that? Did he ask for payment afterwards or did he agree to come on the condition you pay for him?

You are entitled to free legal advice at police interview from a duty solicitor but sometimes if you insist on your own choice who might be out of the area, you may find yourself having to pay.

Did he inform you before he wrote letters that he would charge you? If he did, was this in writing with his charges set out on the letter? If this happened then he should have explained in writing that you could not be reimbursed for that service.

The attendance at police interview is free if it is a local duty sol. Any extras such as letter writing you either pay for (non-returnable) or some solicitors will assist at no charge depending on their time schedule. I must stress though that they do not have to do that. They cannot be expected to do many freebies as that doesn't put food on the table.

Hi,

I did not pay for the duty solicitor to attend my interview and it was the duty solicitor that continued dealing with the police and myself for the duration of the investigation.
I was given a list of charges but was not told I would not be able to claim them back.
Also the police bail banned me from entering my home town meaning that on top off solicitors fees I had to pay 2 months rent (due to contract with landlord) without actualy living in my house. this was another £1000 it has cost me

If you have kept all of the solicitors correspondence pertaining to fees incurred check through it to see if they have actually said you are liable to pay without reimbursement. There should be some sort of client care letter that sets it all out.

You won't get the rent back I'm afraid.

The solicitors were good to me and did not charge me for half the work they did so I would not feel comfatable claiming it back from them.
I do not trust my exe and honestly think she will try something else so want to keep them for use again.
Can I claim the fee's back from the police?
