Hi my name is Donna and i have just joined this site can i first say congratulations on getting your appeal. I went through a similar incident with my husband we won our appeal in 2004 when he was allowed out we had to wait about 5 months after hearing we had been allowed appeal before we actually got to be seen we then had to wait a year before we had a new trail which we won last september. I hope this helps that the truth does come out in the end we have been going through this since January 2003 and finally it has fineshed but then the real battle begins of getting your lives back i wish you the very best of luck Donna

                Hi Maria,

I have a fair bit of knowledge on the appeal system, as my husband has just had a full hearing, his took 16months from the day he was convicted back in November 2004, we had an excellent Counsel who worked on a pro bono (free) after the single judge refused it. We were granted a full hearing for Feb 2006, sadly we didnt get the conviction quashed however we did get a big reduction on my husbands sentence and restrictions lifted, from 5 years to 3.5years and he has served most of that so be home in August 06.

The appeal system is very slow and depending on how envolved the case is and whether the grounds of appeal are straight forward, ours were, my husband was found unanminously not guilty on all counts then there was a large disruption in the court room on the CPS side that the jury found him guilty on the last two counts, and it was this that we appealed on. Our Counsel also worked on a pro bono basis. I also run a voluntary support group for those that have been wrongly convicted. I would say reading your post your partner/husband is doing an out of date appeal due to it taking a while to reach the appeal courts, the appeal courts are very helpful and you can keep track of it yourself. These procedures do take a long time and it purely depends on the appeal courts and how much work they have to do on the file, also if your partner/husband has a long sentence someone that has less to do will have their appeal heard first.

You can post a link here to your support group if you like, Clare.

                    Thanks Diana,

I run a support group for those that have been wrongly convicted of sexual offences, I have been up and running since October 05, and Iam also linked with United Against Injustice that can be found on the Innocent web siteshould anybody be going through alot of emotional pain where they have a loved one, or family member in prison and need general support by a listening ear or help on legal matters and appeal and advice on how the prison system works with these type of offences, please feel free to email me on the following email. convicted-innocent@fsmail,net.

I have been through this myself so have first hand experience of it, I have been one of the luckier ones I have had fantastic family support, a good Barrister with my husbands appeal in which his sentence was reduced by a large reduction and all restrictions lifted he is home in four months where it would of been end of 2008. my husband has been a very strong character through all this, and have had good support from the other voluntary organisations that we are linked to. If there is any question that I cant help with I would be able to find someone who can.

I have done my homework with this type of offence and knows exactly how it affects people and how the wrongly convicted end up having not only their lives ripped apart but the families lives ripped apart as well. I know how the prison System treats them and how they are blackmailed to do courses to address their offending behaviour, how they lose their privileges is they dont do the courses.

All I ask instead of suffering in silence just email me, even just listening to your situation may help.

thank for letting me put this post Diana,

                    clare
