help please

hi all,
a similar situation has happened to me very recently, that I have been accused of sexual assault. I am also very lost and confused. from what I have read its up to the accused to prove consent was given? does that mean im very likely to be charged just because of what she said?

I have also been speaking to solicitors, however they all seem to sit on the fence in terms of how the case look and the expected cost (if funded privately).

any help/advise would be greatly appreciated, as im sure you all appreciate the distress suffered by the falsely accused.

Hi welcome to the forum but sorry you had to find us....there's lots of information in other threads on here - read the one by billykickass - he's just come out the other side. You need to start your own thread too so we can help you with practical legal and emotional support without "borrowing" someone else's. keep reading keep posting and keep strong....

It is long but well worth the read. When you start your own thread write a general outline
of your case, but don't include anything of a personal nature or anything which could identify you.

Your solicitor will sit on the fence at this stage as it is genuinely impossible to tell which way it will go.
It isnt up to you to PROVE consent was given as that is usually not possible. You do need to be gathering anything which may undermine her account however.

Do not speak to the police without a solicitor present. Do not pro-offer evidence you find to the police without a solicitor's permission. The worst part is the waiting. That's where this forum comes in. Feel free to share your thoughts and look around. We will help you as much as we can.

hi all, thanks to your messages before and I have read the recommended thread. i was charged earlier this week, and any advises would be much appreciated?

how would I be able to tell whether my solicitor is doing a good job?

hi fa13 - your solicitor should have a recommended QC as well - the QC will be the one who stands up and defends you in court. Your sol should be inn contact with you and asking for lots and lots of info to build your defence case - texts, emails, FB pages CCTV footages, letters etc etc anything that can prove you weren't where she says you were when she says you were or to prove that the sex was consensual. If your sol isn't doing anything then they're not doing a good job......... Hope this helps......

so it is my solicitor who builds the case, and the barrister who takes the solicitors' work and represent me in court?

would i need to take my case to several solicitor for them to evaluate and choose the best one or stick to one i have choosen(the decision was base on ranking from legal500 and uk chambers before i was charged).

any advices would be grateful, thanks!

I can't answer that one as I don't know - but someone will be along here soon to help you. The advice is always to have a solicitor who specialises in FA of a sexual nature.....
