  • Really odd case help!!!

    Hello everyone,

    3 weeks ago me and a friend went back with 2 girls from a club, after my friend went to bed with the second girl me and the girl i was with went to her room, here she undressed and we briefly had sex aswell as me giving her a hicky(love bite) before she jumped up claiming to have been raped.

    I was very drunk and knowing that was not the case severely understimated the gravity of the situation and went and stayed at his house, my friend stayed with the other girl,

    i was up for a few hours longer before i went to bed, after only a couple hours sleep my friend came home saying that police had been to the house. he then texted the friend of the girl making the accusation asking who i should contact, she then phoned and spoke to me. I asked what was i meant to have done and if i could speak to the accuser. the girl said no as she was with her mother.

    3-4 mins later the phone rang again and the girl accusing of rape spoke to me on the phone and when i asked the problem she said that she did not like the fact that i was biting her neck, i apologised if it was too rough and told her i was not a bad person, as for me a rapist is a bad person as it is a crime with no excuse, and she then emphasized that she did no 3-4 times,

    i then asked for the number of the officer incharge of the investigation but she told me to go to a police station. What really confused me was how cheerful and upbeat she sounded. i then left for the local police station with my friend where i was arrested

    i did not want a solicitor for the interview as i naively thought that the accusation would not go past the evening. at the time i was not 100% sure whether we had actually had sex, i said i did not want to lie and that i wasnt sure but after being pressured into giving a snap decision said no as i was not sure if i had and did not want to incriminate myself.I could also not recall there being a condom although i now think there was but she had to have supplied it. I also recall the girl having my phone, which the police now have and am worried with what her intentions were with it.

    Over the next 2-3 days i recalled so much information from the events, some relevant, some not but the police would no longer take and information from me and it has been worrying me as i have been telling the truth but have realised so many things that i wish i had said in the interview.

    There are however some details in my favour, showing that the girl has been lying. the day after the interview her friend(and housemate) told me that she had been told by the girl that she had taken her clothes off despite her telling police that i stripped her. She also found messages on the accusers facebook to another one of her friends in which she is asked the same question and replies that she took her clothes off, aswell as being asked if i stopped when she wanted to which she replied that i did. The OIC has allegedly taken pics of these messages. She also did not tell officers that my friend was still in the house when they came. she has also been seeing a psychiatrist and taking anti depressants. Her friend also told us that she had denied the phonecall taking place to the OIC despite the me, my friend and her friend all confirming it.

    Don't tell the police anything

    Hi there and sorry to hear what has happened to you.
    Firstly, don't make the mistakes me and others have, by telling the police every bit of information you come up with. TELL YOUR SOLICITOR. if you get anymore visit from the police, just say you want your solicitor present.
    I hate Facebook but I must say it has some qualities of gossip which is to your advantage.
    Let's hope this isn't drawn out too long and you can be free from this nightmare. I would also hope that there is a big lesson to be learned here which your friend had a narrow escape. You will both grow up very quickly now and learn a lot through this. Keep us posted and all the advice you need will be here for you. Your not on your own and we keep our fingers crossed.

      I am sorry to meet you in this context but you have already been given excellent advice by Hol.
      You didn't feel the presence of a solicitor would be necessary as you didn't rape the girl.
      A few of us made the same mistake but next time you will go to the police station do not underestimate the importance of this help.
      In the meantime do not contact the police,they only want you convicted.
      Only trust a solicitor and if possible who is specialized in sexual matters.

          Hi reallyneedadvice - welcome to the forum but sorry you had to find us. Can't really add much to the good advice you've already been given, except to say read lots of the threads on here and some of the stickies as well. You will get lots of advice and emotional support too - keep strong - sadly there's a lot of us here.

          Just as a matter of interest, I'm not sure of the significance of adding the info that she has been seeing a psychiatrist and is taking anti-depressants?

              thank you for your replies, i regret not taking a solicitor and have tried to contact some since but do not know which are right for me, i am a student so cannot afford to pay.

              To myhome i just feel that it could be part of the reason she is doing this, i wouldn't wish how i feel on my worst enemy so for her to be putting me through this shows that she must have a real problem, first of all i was angry, now I think that she must be ill and in need of help

              These accusations have completely changed me, i feel a shell of what i used to be and just keep praying that it will end soon so I can go back to feeling like myself again.

                Hi,

                There are some recommendations for solicitors in a thread in the 'useful information' section of the forum; these specialise in defending false accusations and most will work on legal aid cases.

                Bear in mind though that these won't be able to make a claim for legal aid on your behalf unless you are charged with the offence and won't be able to get any information about the case until then.

                However if you are reinterviewed for any reason, they will get paid for attending this with you, so it's quite useful to make preliminary contact with a suitable firm at this stage.
