    Hi guys

    I have been through the usual process everybody has been through in here.
    I discover her escorting behind my back (and taking part into an illegal escorting business), I face her, she says she's sorry, but later I discover more lies and I told her we are done - she knows I'd do anything to keep my child and therefore 20 minutes later I get woken up by the police The police has seen the truth quite early on. I received my NFA in 5 weeks, early December.

    I did not employ a specialist solicitor, just the one who was assigned to me at the time of arrest, as the police told me early on that the investigation was not going anywhere.

    Now I read on this forum that NFA is different from "No Crime" - therefore I'm wondering: what are the next steps to finish cleaning up this mess (created by my ex wife)?

    Hello and welcome to the forum, glad it didn't drag on for months for you.

    It is not impossible to get a no-crime, I believe one of our members did manage it, hopefully he will see this post & respond, but a simplistic reply would be that your accuser would first need to admit to the police that she had lied regarding the accusation against you.

        This is interesting.

        Were you both NFA'd before the end of bail or when you returned? Im on bail for 10 weeks and wondering if this should be a worry..

        As per previous posts, the "victim" would have to admit a false allegation for you to be cleared as NFA is usually just due to insufficient evidence as far as I am aware. I would have thought a text message or similar completely clearing you would also result in "no crime" too? But it would need to be something ridiculous that proved without any doubt that there wasn't any offence committed.

          You can search for my other threads bit I am in the process of seeking NC after an effective NA . My case has been with the exceptional cases team for 7 months via my excellent MP. No result so far. I am not sure it is true that she has to admit she lied for it to become NC. It is for her to be charged with PCJ

            I've been reading up on your threads over the last few evenings. Good on you, and good luck. I believe The Advocate also had a successful result after a substantial amount of discipline, motivation, and hard work.

              I heard my name in cyberspace and wondered who could be talking about me!

              I applied to have my dna, police records etc destroyed. AIUI this is different to a NC categorisation, as there is no automatic deletion of dna etc even if something is NC'd. However, I haven't bothered to go for the NC as the Met Police's policy is to to consider that "where there is NO doubt that NO crime has been committed, the dna etc MAY be destroyed. " (my paraphrasing and emphasis) So as far as I'm concerned, in my case no crime was committed, the Police have advised that, and I've got the bits of paper to prove it.

              I've posted about how I did this, and the circumstances surrounding it. Have a look at that and get back to me with any questions.

                Just so that I understand immediately whether this is just going to be a waste of time or not, a couple of questions, in case anybody has anything to say.
                1) I have a spent conviction for "Refusing to provide a specimen of breath at the roadside" for which I received a £50 fine and 28 day driving ban. This was back in 2001. Does it mean that it is rather pointless to apply to have data destroyed (i.e. dna, fingerprints), as it will have to stay on file for the previous conviction anyway?
                2) I somehow managed to get back in touch with my wife in friendly terms (don't ask me what kind of zen techniques I've used to maintain my cool). We have a child together and there was no choice. She told me she told the police not to proceed against me already on the day following the rape allegations. Nevertheless it took 5 weeks for my NFA (I think the policewoman was on holiday, so that might affected it... Geez while I'm on bail and can't go back home). Now, can she not admit to the police that she was just "confused" the night of the accident? That she had mistaken our (very poor) sex for rape because of her (very poor) mental state / depression / fears whatever? I'm trying to find a formula where she can contribute to move things to NC for me - that is *without* incriminating herself with PCJ.

                Any comments welcome.
