    hi all

    hope you all okay

    I needed an advice. as you all know about my case and police have my passport so i can not get a job and, that this case can go for nan other 6 months or might an year or probably more. so it is like kind of wasting time so I am thinking to go back to university and do my masters in engineering. as if the case can go more longer, atleast i will not lose anything but gain something in the end.



    1) In a application form, they want to know about my any conviction that is unspent yet,
    do i have to tell them about my case that is right now in investigation and i was arrested for suspicion of rape

    2) They also want to know my status living in UK, as police is not ready to release my passport but is it worth asking for atleast photocopy of my visa or indefinite stay in UK?

    3) I can't speak to the investigation officer but my solicitor can, but is it a problem if i call my solicitor often to ask him about the case progress and that? will he mind because i am sure he have other cases to dealt with.

    Apply for a replacement?

    Good idea. Masters will stand you in good stead.

    If they ask about convictions then you can honestly state you have none as far as your present situation is concerned. Read how they 'word' the question and if it's asking about convictions then you have not been convicted. If it asks about 'current accusations' then you would need to provide info.

    I fail to see why they are holding your passport. It would of course be worth obtaining info regarding your 'status'. Stating it on paper may be enough to pass the hurdle in the present time with them requesting documented proof (passport) hopefully at a later time?

    Don't ask you don't get. Showing an interest could be beneficial. The solicitor is there to serve your needs they will most likely tell you when there is 'little they can do at present' at which point you give them a break for a couple of weeks...

      Great advice! Apart from 'the solicitor is there to serve your needs". Not unless he's charged, he's not as there is no funding. Some sols will help out of goodwill if they have the time but they really don't have to.

      Giving the sol 'a break for a couple of weeks' doesn't mean that he might magically be able to help.

      It's a worrying one I have to say. Is it worth contacting an immigration lawyer, stressed out, to see where you stand with relation to your passport/visa status? You may well qualify for funding for that and you may well be able to push this further along.

        I would say no. You haven't been convicted of anything (and hopefully you never will be).

        When I applied for uni (2009 and 2012) there was also this question about living status. I didn't have a passport when I applied (had no intention of going abroad) and there were numerous other ways I could prove my status including getting a professional to countersign a copy of my birth certificate. I don't know what other proof they will accept for indefinite right to stay in the UK but I imagine there will be other ways to prove it (do you have an out of date passport with a visa for example?). You might be able to get the police to countersign to say it is an exact copy. Don't let this hold you back. There will be a way around it.

          You know what my problem is?

          I keep assuming everyone lives in Scotland.............

          If you're paying for a solicitor then by all means keep in touch, they'll add it to the bill.

          A break for a couple of weeks was to allow them to possibly do 'something'. Not saying they will do anything but it's a long drawn out process and if you're used to contacting them weekly then move it to bi-weekly and then monthly. Break the addiction.

          Until charges come along there is little anyone can do............

          Next time you find yourself falsely accused just make sure you're in Scotland... Everything seems so much more simpler up this way!

          Saying that.......... There's a lot of changes happening just now...........
