  • The witch hunt, false accusations and the damage so far..

    Hi guys,

I just thought I'd share what ive been through in the last week or so following another awful story of revenge that's ruined everything and still has the potential to get worse. I'm hoping someone with some experience with a similar situation or and legal training could shed some light on where i stand..

I had the police turn up at 6.30 in the morning last Wednesday, inconveniently it was my morning off work so a lie in was on the cards but i was arrested under suspicion of rape of 3 of my ex's dating back as far as 2009, an allegation of burglary and threats to kill were thrown in for good measure along with a count of taking indecent images of a minor (cant remember the exact wording, but this was to do with one of my first girlfriends back in '09).

As per most stories on here i was karted off to a police station on the other side of the county, booked in and thrown in a cell by 8am after some mugshots, DNA and fingerprints being taken. I was held for a little over 12 hours, burnt through about 4 and a half hours of recording tape being questioned (i refused a solicitor as i had nothing to hide) and bailed until the end of February. All of my belongings such as iPhone, laptop etc. were seized and are still in the system for an undisclosed amount of time following a search warrant being executed. I had requested that the arresting officer contact my work to inform them that i wouldn't be able to attend while maintaining my privacy as much as possible. This didn't happen. Work called home when i was AWOL in the afternoon, and i was informed upon being bailed that work did know my whereabouts but only because officers had executed the search warrant at my workplace- a large corporate office of a major IT company. Needless to say i was called up the next morning before attending work and dismissed due to being in my probation period.

So throughout this 24 hours we have my incarceration for 14 hours from the moment of arrest, seizure of most of my worldly belongings, questioning of the most intimate details of my life for a little extra humiliation and the loss of my job because of the whole situation. A lot for an innocent person with no criminal history to have to go through I'm sure most will agree with..

A month ago i was informed through friends and family that it was being gossiped at a local coffee shop that i had raped someone. I thought nothing of it after making a few inquiries with ex's and drawing a blank. I was aware that all 3 of the ex girlfriends had been in contact and it was general knowledge that (without sounding too dramatic and paranoid) there was a plot to get me. Again i thought nothing of this as im not one to be slighted by threats and rumours.

All 3 have motive for the false rape allegations. The first was charged with assault after punching me repeatedly in the face following the break up. The second miscarried with our child (yes we were trying for a baby at her request when i supposedly raped her) which she blamed on me due to stress and knew she had a small claims case coming up against her for money owed. The third has an extremely troubled past and there was a disagreement about her capability to care for her 1 year old after i spent most of my time with her cleaning her flat and looking after the baby. In regards to the photo's of a minor- this was back in 2009, the girlfriend at the time was 17 and i think i was 18 or 19. She had recorded us together in bed on a mobile device or laptop and appears to have made an allegation that i created said images or video without her consent. All allegations happened at the time i was in a relationship with each. All 3 girls have been in contact in the last 6 months over facebook trying to be friendly.

Im pretty certain that when i return from bail and re attend the police station evidence and investigation will show they have been in contact with each other over facebook along with my facebook messages from them which i happily provided my login for them to look at with my consent (not that they needed it!)

How does anyone see this playing out.. Am i likely to be remanded into custody and charged following my return to the station pending a court date?

Also repercussions on the so called "victims"- Can i sue for defamation of character, loss of earnings etc. to reclaim damages financially as well as seeking a criminal trial for the false allegations (i believe this falls under perverting the court of justice)

Any feedback or information would be really helpful even if its not reassuring as nobody seems to be able to assist- including my solicitor who will be joining me at the end of February.

    Thanks in advance.

    Steve.

Hi Steve, not exactly a good Christmas for you!

I suspect that when you answer bail, you will be rebailed for a further period of time. You have not admitted the offences and the CPS are unlikely to come to any decision until your laptop and phone have been examined; this alone may involve a wait of some months. Provided that you comply with the terms of your bail in not contacting the witnesses, you will not be remanded.

I can understand why you think that your ex’s have collaborated on the accusations against you but I fear this will not affect the way the CPS view the matter; it is often the case that during the police enquiries they will trawl round for any other possible ‘victims’ so your ex’s have done this job for them!

The police will be interested in collecting evidence to support the allegations rather than trying to establish that your ex’s have colluded in falsely accusing you, so really it is down to you to try to show that this has happened. If you could positively prove this then I’m sure that the police would view this seriously and take action against them for wasting police time, but at the moment it seems like a word against word scenario.

However I would suggest that you collect documentary proof that they knew each other at the time of making the allegations (such as screenshots of their relevant Facebook friends pages) as, should the matter be taken any further, this could be useful in formulating a defence strategy. It would be best to do this immediately as they may be advised to discontinue contact.

The accusation of taking indecent images of a minor is a grey area. If your ex recorded the images on her phone you are in the clear unless you then copied them; if she took them on your phone this is more tricky, once again it will be your word against hers if there was consent to record the images. It is a mockery of justice that you are legally able to have a sexual relationship with her but not take or posses pornographic photos of her; however I suspect that this accusation is an add-on to bolster the rape charges, it is unlikely it would have gone ahead as a stand-alone charge.

You mentioned that you have now contacted a solicitor; hopefully this is one who is experienced in defending false rape accusations. There is a sticky at the top of this section of the forum with member’s recommendations of firms they have used.

Many members have been in a similar situation to yourself, and will doubtless be along shortly to offer coping stratagems to deal with the waiting around.

        Hi Steve
So sorry you're in this position. I can't offer any legal advice either as I'm new-ish to this site as well (about 4 weeks I think), but just want to say welcome and that I've found everyone on here tremendously supportive both in "practical" advice and emotional support too..... It's a nightmare beyond anything I've ever experienced (and I'm 55!!) and the rollercoaster of emotions is difficult to say the least. You may want to see your GP at some stage....mine has been brilliant....

Plod are not interested in anything but cashing in on the triple payday that you are - wake up - triple rape!

It won't matter a bit if they knew each other or not, unless they said they didn't under interview conditions.

Not having a solicitor present was your first mistake - do not make it again!

You are in IT - use that geek money to get a real hitter to represent you - a real specialist or you might do serious jail with real rapists and kiddie fiddlers - don't underestimate this one.

Oh - and when you use the right solicitor and win, you won't be able to sue etc - you'll at best skulk away and spend a couple of years trusting and getting back to zero whils your false accusers (FA) summer in Turkey on 11k each!

Long time on bail, no PC's back and when you get them back, they'll feel dirty and you'll have to ditch 'em. Depression will be the default so go get help NOW and possibly meds.

The above is if it goes well for you.

I would future-proof this **** and go learn a new IT skill that will get you ahead of the gamem

          Good luck Steve.

Steve 22, I'm sorry to hear about the frightening predicament that has led you here, but it's good that you have found the forum.
When i first arrived here it was suggested to me that I request counselling from my doctor. I did, and was referred by the NHS, and had the chance to talk through my story with a sympathetic trained counsellor over many weeks. Even the regular weekly appointments gave me something constructive and positive to maintain my equilibrium, long after my NFA notice. You may be surprised just how sympathetic medical professionals can be to your ordeal.

It is a rollercoaster experience you will find yourself on... you will be doubting your faith in humanity.... your accusers have seized the role of victim, yet it does sound as though you are the one who is being victimized.

You say the motive seems to be revenge in each case. Also, there is the issue of CICA claims, which I understand could so obviously tempt women to lie.... it does seem to be quite mad, but true, that thousands of pounds of government money can be gained by way of 'criminal injury compensation'

Take care Steve, and keep us posted on developments, or just call by to talk, or let off steam.... The pain can be unbearable, but there will be an end to it... Other peoples' suffering can sometimes give you perspective on your own...

            You are not alone.

                I did sugar-coat it a little...

..."I would future-proof this **** and go learn a new IT skill that will get you ahead of the gamem"

Staring at the floor for hours on end each day on bail waiting for an undeserved place on the nonce-wing damaged me in a way that a few of you will understand.

Steve will understand this in time too.

One member has said that FA has given him a new lease of life and has taken to extreme sport possibly because he has already stared a death in the face and fears no more.

Back to Steve - get more skills that pay as a contractor/freelance because no-one wants you now nor in the future - you'll never be let near a server again as a PAYE.

Lol learn something that you can use to diminish the life experience of FA's - something legal that would indirectly be a flea upon your Macbethian FA's lol

The lols are like "" intending to be of novelty nature only.

                I love disclaimers!

Oh and Dave, I'm having a great week and hope that you and the other members are too. Try to read my posts with a little pinch of salt - that's just my way. It really gets me down to think of my fellow man going through what I did. Also, only a small proportion know of this site.

I was a teacher for 27 years (guess where the FA has come from!!) but I've never been "street-smart." I have lived and worked in rural areas all my life - so sadly lacking in the "street smart." Hoping solicitor can help me out here!!! Thanks for the advice....

I don't think they will remand you and keep you in custody. They should let you out on bail.

With me I breached the bail conditions because she was always calling me wanting to talk. Stupid me thought she was feeling bad about her lies so I talked to her. That got me 2 months in jail because I was unable to meet the new conditions for another bail. I had to remain in custody until my trial and then all the bull**** charges were dropped and I was free to go home.
