    Please can somebody help and advise us, I have never done this before and i am a complete novice. We are a shattered broken family our son has been falsely accused of sexual assault and attempted rape by his ex partner. Our son is a shadow of his former self he is hurt and bewildered by these allegations we cannot understand how it could happen. I would like to explain the allegations in more detail but I'm unsure how much I can say. The allegations were made in may and he was arrested but released on police bail without charge. He was then charged in November. He has a solicitor but we want to make sure he has the best defence he can get. The things that she is saying are horrible and complete lies and because they have charged him we are scared that he won't be believed. I can't describe the anguish that I feel watching my son suffer in this way please help. Thank you.

    Sorry you find yourself here but you're in good hands.

    You are welcome to say as much or as little as you wish. Obviously the more you say the more people will be able to assist. Remember not to post names or anything that can identify you or your son.

    If you were to list your county (only your county) then members will be able to advise on solicitors. You can also post the name of the practice of your current solicitor and see if anyone has any info to share with you. You have the right idea with wanting the best possible defence team.

    I am assuming that you are in England or Wales.

    A charge does not necessarily mean there is definitely going to be a trial but it a step towards it. Has your boy, or you, been piecing together a defence/gathering evidence?

    It's a nasty world out there just now and with all the media frenzy happening it can only get worse.

      Hi Maryrose, welcome to the forum. You'll find most people on here do know how you're feeling, several of us are on here supporting our sons, others their husbands or partners as well as those who have been directly falsley accused.
      L1's recommendations about a specialist solicitor are spot on, I wish I could have persuaded my son to change solicitors a long way back. You'll find this site can be very encouraging at times and fairly gloomy at others.... it depends what's going on.

        Thankyou both for your comments it's good to know we are not alone. It's sad but comforting to know that others share our worries and fears. We have only just received the court papers from the solicitor with her statement. There are also witness statements made by people who have never met my son and the evidence they have given is based on conversations they have had with her. One of them is so utterly ridiculous that I'm sure (and please don't think I am being flippant ) she has used extracts from 50 shades of grey. Another one states that she told them my son was a drinker and he would be violent towards her when he was drunk. My son does not drink he is a professional driver he was regularly tested and would not take such risks. These people do not my son how can they be allowed to give such damning evidence this is a person life we are talking about. One thing that really upset us all is at the top of page 1 it states
        VICTIM his ex
        OFFENDER my son.
        Shouldn't it be plaintiff and accused?
        I have lost all faith in the police and justice system how can this happen it appears that in their eyes my son is GUILTY because she said he is. We live in Derbyshire would be very grateful for Amy advice you could offer thank you for listening.

          Is this a Courts Martial matter or civilian?

          If her allegations are out of FSoG then I suggest you identify the passages and point them out to the solicitor. You say you have a solicitor. May I ask who it is?

            I'm not sure if they are extracts out of the book I suppose it was just a weak attempt on my part at trying to be sarcastic,however the allegations in this particular witness statement are so absurd they could only be made up. Our solicitors are Cartwright king.

              Oh sorry. Sometimes liars actually use the script from a book or magazine. I've even come across some that use soap storylines to fit their own.

                No I think I may have misled you. I have never actually read the book but from what I've heard there is reference to some of the things she is alledging. Can this evidence be used in court? I'm sorry I forgot to add to my last post that this a civilian matter. Would you advise to continue with our solicitor or should we start looking at a specialist solicitor. Thank you for your time it is very much appreciated.

                  I would look for a specialist. To start looking you first need to know:

                  1: is he eligible for public funding?

                  2: if he is, will he have to contribute?

                  3: would it be worth him paying privately - bearing in mind that if the trial is dumped beforehand or the jury return not guilty verdicts, he will not be reimbursed the full sum (as per after the new October rules).

                  I don't need to know the answers to the above but you do when considering who to instruct. The sol in my signature is VERY reasonable and charges a fraction of some sols and so-called 'experts' charge, but he cannot take on publicly funded cases as sols are only paid by the case now, not by the hour. He puts in all the hours God sends and deserves to be paid for it.

                  I am actually reading the FSoG trilogy after I saw some 'liars' and their cohorts on Facebook telling all and sundry that they are reading the books themselves. The books are not exactly literary wonders but if I come across trial paperwork for appeal that reminds me of the books then I'd be on it. A genuine victim obviously wouldn't use the exact words. Liars have done in the past, as I said, especially when copying soap storylines.

                    Hello Maryrose and welcome to the forum.

                    I am sure all your family must be devastated and sick to read these accusations but to be charged doesn't mean your son is guilty.
                    It is now time for him to find why his ex falsely accused him of rape.

                    Does she has any motives to do this?
                    Money,revenge,jealousy,...

                    Your son must have witnesses,colleagues or friends who can write character references for him.
                    He must prove that he is not a drinker, nor violent...

                    You will have to keep faith and strong for him.

                      Welcome ..I am also pretty new to this and it is my hubby who has been falsely accused.
                      I can't give you any advice, but I have huge shoulders and you are welcome to use one or both
                      if you need.

                        I would have to comment though....

                        A real rapist could read those books and act out the scenes in a twisted twist........

                        Obviously lies are never particularly hard to see through and then it's only a matter of ascertaining where they came from and hitting the person with it when they're on the stand.

                        Maryrose, I'd recommend you read the trilogy so you can form your own interpretation, it could prove invaluable and is also a mighty good way to get off to sleep at night if you're having issues. I've read an astronomical amount of books over the past year odds.

                        The Police/CPS WILL make it seem as if your boy is guilty,, that's what they do. They care little about the consequences of their actions as they are virtually immune to any come back and whilst your boy is fighting for his reputation and freedom they're simply picking up their paycheck and processing through their next 'client'. Don't be dragged down or suckered in by their self serving and self righteous attitudes, really clever people don't become cops or prosecutors (some do pass through though). The state generally only wins because there are more of them than the individuals they pick on.

                        Your legal team can make a big difference. A weak one will see your defence overwhelmed and a jury misled into returning guilty verdicts. A good one could see Not Guilty verdicts and an awesome one would include Rights Fighter.

                          Hi Maryrose and welcome.
                          You have been given excellent advice so far and there isn't anything I can really add.
                          However, your son is a professional driver and regularly gets tested for alcohol and drugs. If one of the "witness" statements is alleging that he was a drinker it might be worth looking back at his test results to see if you can match the dates to prove he wasn't drinking then.
                          Gather witness statements for your son as well.
                          Your sol may be able to argue that these statements from people who have never met him could be inadmissible under the hearsay rules.

                            Malicious baseless defamation of character. Pull all his medical records as well as driving records and have them presented as evidence.

                            Clearly a lack of evidence of the actual 'crime' alleged so they've turned to attempting to destroy his image instead.

                            Don't let them away with it.

                              Thank you all for your advice and words of support. After the initial shock of reading the police report and the "witness evidence" we have now read through it again several times and are already finding lots of inconsistencies in her account of the sexual assault and attempted rape allegation. She is also claiming that my son violently attacked her 3 weeks prior to that , also untrue. I would like to add that this woman has made claims of this kind in previous relationships. We know that one of these claims was not reported because ironically my son and I tried to encourage her to do so. The previous relationship before my son according to her was reported and she had support from a domestic violence unit.that person went to prison with support of her evidence however he didn't go to prison for domestic abuse it was for an entirely different crime. The domestic violence that she described to us is almost identical to the violence she is alleging my son has done to her. I wish I could tell you all more about these previous claims she has made but I'm worried it may identify her. I am astounded and shocked that someone could be so wicked.We have been exploring possible motives for these allegations and we've come up with a few between us. My son has spoke to the solicitor today and is feeling more confident but still devastated.thanks every one for listening I feel like I have made some new friends thank you all and good luck to you.
