  • I am a Victim of False Allegations of Rape

    Hello. My name is Khan and i was falsely accused of rape and false imprisonment by my ex girl friend on the 1st of August 2005. She wanted to marry me and i was not ready, therefore we split once in the past but got together again. We went to my office at night and agreed to have sex. I did not know that she had already made a revenge plan with another guy she used to date with in the past, and therefore she phoned him to call 999 that she is being forcefully detained and raped in my office.

    I was arrested and was questioned. She was questioned by the police as well and she lied in her statement that i have been blackmailing her that i possess her pictures that i will show to her family if she did not agree to my demands. She lied that i drugged her drink and raped her. She had put the remaining sleeping tablets in my unattended trouser which were found in my trouser pocket when i was arrested. I was dissmissed from my job. The police searched my house and work place and did not found any pics. I told the police in my statement that she has made up the story and is totally fabricated. I admitted that we agreed to have sex on that occasion but it was consenxual.

    I was given police bail to return after 2 months as the police needs further investigation. When i reported back to the police station at the end of September, i was again given bail again to report in November. I will be returning to the police station in the first week of november now. I have witness who know about our relationship in the past and her intentions to marry me. 2 of my friends have already been questioned by police when i was arrested, and they told the police about our relationship and that they saw us together on that night just 30 minutes before she called the police.

    I do not why she did this to me? She ruined my life and reputation. She is asylum seeker and she might have done it to get compensation benefits as well as revenge on me. I lost my job and my income. As she made up the whole story ad lied to the police, will she be prosecuted for a false allegation complaint and waisting police time?? Why the police is taking so much time in deciding about the case? I was informed by my solicitor that the police has sent an Advice File to the CPS and that they are waiting for the reply.

    Please give me any useful advice.

    Firstly, my sympathies. as the accused, you will have little sympathy from the police, and there is little counselling that anyone can refer you to, unless they have been affected by false allegations themselves.

    have a look at FASO, the false allegations support organisation. Val, who contributes to this site is an advisor for them. they are very supportive and can offer good practical advice. Val also runs the JGC website, which has some very useful tips, so check out www.kotae.co.uk and click the JGC button.

    the most important thing is to make sure your legal representatives are experts in the field of sex related crimes. it is not too late to change your solicitor if they are not experts. make sure you tell them every miute detail you can possible remember, make sure you question them on everything you do not understand. your life is essentially in their hands, so make sure they are competent. i can't stress enough how important it is - our solicitor was appalling, and kept fobbing us off. unfortunately for us, we trusted her to be the professional she claimed to be, which was probably the main reason my husband was convicted of a crime he didn't commit.

    Make sure you look after yourself. enduring this is terribly stressful, and will take its toll physically.

    As for why she has done this: take your pick! revenge? to get attention? because she enjoys playing the victim, and getting sympathy from others? because now she has told the police, she is trapped, and has no option but to follow it to its conclusion? women (and men) make up allegations of sexual assault for all manner of different reasons. if she admits she has made it up, she will face prosecution herself, and a possible jail term. have a look at borderlione personality disorders (type it into google) and get your solicitors to look at it.

      Thank you very much Saffron for your useful advice and tips.

      I have changed my duty solicitor after talking to the FASO help line. They are indeed very kind and supportive. As you suggested, i tried to check the JGC website (www.kotae.co.uk) but its not available at the moment.

      I do,t know why thepolice have,t yet contacted and interviewed some of the witnesess, my solicitor mentioned in a letter to the police. They know about our past relationship and her intentions to marry me. As i mentioned before, one of her motives of falsely accusing me of rape might be to get criminal damage compensation. Is is true that even before the case goes to the court and before conviction, she can claim compensation?

      Also, is it possible to get full disclosure from the police once the case is decided.?

      I appreciate everyone who devotes his/her time to provide advice and support to those falsely accused.

        Hi Khan

        Hope you are doing OK.

        in answer to your questions, the woman concerned can certainly apply for compensation before you are even charged, but I am not sure whether she will be awarded it. if you are intending to use her desire for money as part of your defence, then it could be that her application for compensation before you have even been charged would go seriously against her, although i am not sure if an application would be disclosed to you.

        Once charged however, your solicitor will get full disclosure from the police. in my husband's case, they gave us a big file of stuff with "not for disclosure" written on it, this included the fact that his accuser had withdrawn her rape allegation a week after she made it, and changed it to indecent assault. However, the police chose not to tell my husband this until they finally pressed charges, and gave us disclosure nearly 4 months later. so for 4 months he thought he was facing a rape allegation.

        the police will not be overly concerned about unearthing any evidence which may clear you. They under tremendous political pressure to increase charge and conviction rates for rape and sexual crimes, so will "forget" to collect evidence from people who may be helful to your case. Your solicitor should be pressurising them into collecting these statements.

          Hi Saffron,

          Thank you very much again for your kind advice and support.

          Unfortunately, i was given police bail again to return after 4 weeks . I was informed that police officers from another police station wants to question me regarding a past complaint she made aganist me. I know a little bit about that matter , as when i left her the first time, she was furious and i heared that she made up a story and when she was in the town centre with another guy, she was dating with, she called 999 that she was attacked from someone behind. She put it on me and gave my name to the police as a suspect. The police did not contact me regarding that matter at that time, but now i was told that as both cases are linked, therefore, the CPS wants the police to interview me regarding that case as well.

          Do you think, that the CPS has,t sufficient evidence to charge me in this false rape complaint? and therefore, they want to strengthen their case by trying to find some evidence of past assault and domestic violence while the fact is that there is no truth in all her complaints and she made up that stories to revenge on me.


          I will be going in a week time time to be questioned by the police officers in that past matter.
