Hi everybody just a quick question if anyone can help me out. I have been accused of rape and assault by my ex wife. These are all lies just to get her residency in the uk as she is a foriegn national. I just wanted to know my case has been with the CPS for about 4/6weeks. The longer they take is this an indication they are lookIng to drop the case? Also what say do the police have in the matter regarding the dropping of the case? The investigating officer said he was looking to drop the case yet still proceeded to send it to the CPS. Do the CPS consider the officers opinions when making a decision?

Hi and welcome, it's impossible to answer your question. In my case the police told me my papers were with the CPS and I later found out they were not, the police also told me the decision was solely with the CPS but I later discovered the police make reccomendations and are present during the decision making meetings. I afraid to say it' just waiting game.
In the mean time write down everything you can think of as to why she would do this and anyone that can back this up and start researching for a good solicitor that deals with this type of offence - a specialist solicitor. I highly recommend you contact the solicitor in rights fighters signature box as he is excellent.

Thanks barney. The investigating officer actually said he was looking to drop the case so hopefully he has made that reccomendation to the cps. The sole reason for her going this route is to get indefinate stay in the uk. If she had a baby in the uk she automatically would get residency which she hasnt. Or another route is screaming domestic violence in order to gain stay in the uk. The rape has been added to make the case stronger i guess.
