  • Set up and convicted!

    Please help me somebody
    My friend had been falsely accused of rape by his new wife back in February.
    They had not been married for very long and there were always issues in their relationship about money, she would take money from him and place it into her private savings and she encouraged him to buy an expensive house in the country that he can barely afford the mortgage on.
    I have watched my friend go through 6 months of pure hell waiting for the trial, his young children have watched their father's health deteriorate as the worry and anxiety have set in. His family have shown a great deal of support towards him, and i have sat and held him every day whilst he has cried.
    Last week he went to crown court and the jury came back with a guilty verdict after 5 long days of agony. He has been given until the 20th September to come home and sort his business and his children's welfare out before sentencing.
    Some evidence was used in court against him from which the jury made their descission, which we believe shouldn't have been used. He has been set up!
    What can we do?
    Please help?

    hi i am so sorry to hear that and hope you get through this difficult time, i can only give you support at the moment and more experienced members will come along to give you advice in the mean time try to come over the emotions you can start am appeal and i am sure someone will advice you about that very shortly, could you please describe the case generally not specifing any thing so that member could advice on that basis

      Hello and welcome to the forum though sorry to read of the reasons that brought you here.

      We do have a member who has comprehensive experience with appeals, hopefully when she sees this post she may be able to advise you on the practicalities of this.

      In the meantime a few general comments:

      I guess you mean that this evidence should have been inadmissible and should have been ruled out by the judge. You really need a barristers opinion on this: did your friend query this with his barrister during the trial; also did his barrister advise him at the conclusion of the trail as to the likelihood of being able to launch a successful appeal.

        Thanks for joining and I am sorry that this has happened.

        Obviously without knowing your case, no one can say whether or not there will be grounds for appeal, however, its worth bearing in mind that many barristers will tell you after trial that there can't be an appeal. This is not necessarily true so if the legal team said this, do not lose hope.

            I'm just a little confused... He has kids, a family home and a wife and your login is 'guttedgirlfriend'.

            If you are his girlfriend were you with him when he married his wife? Did she find out and so report him as a way of getting back at him?

            I'm merely being nosey, no need to reply to the above stuff....

            Just now will be utter hell for all of you. Has the legal team given any indication as to what the likely sentence will be? I am assuming that he is also going to need a solicitor to deal with a divorce?

            We'll all have lots of questions, don't feel as if you need to answer them all! It's a shame that you are here so late on BUT an appeal is more than an option and something that should be vigorously pursued, especially where an injustice has been served. Juries don't always get things right!

              I reitorate that you shouldn't feel the need to reply to that.

                The OP has stated that the accused is her friend - he is male and she is female - it can happen that friends are the opposite gender.

                I think you are over reading and over thinking some posts Lawless.
                And God promised men that good and obedient wives would be found in all corners of the world. Then made the world round .... and laughed and laughed and laughed ..

                  I am sorry to read what happen to your friend and you mustn't be offended but try your best to get him out of this nightmare.

                  She must have a reason for accusing him of rape,do you have any idea?

                  They were newly married so she didn't have the time to take enough advantage financially.

                  I feel sorry for him and hope that the appeal will be available.

                            Bit personal there. I seen a hell of a lot of similarities to a situation I'm aware off and just had to ask. Silly of me but I wanted to see if these kind of things were common place or not.

                            It must be hell of a good to have a close friend of the opposite sex who is willing to do so much for you. I really did want there to be some romance in it! I'm a sad old barsteward... Sorry.
