  • Help and Advice - Falsely Accused of Rape

    Hi
Have looked through most posts here and dont think this has been answered but i might be wrong.

Nearly 5 years ago now I was arrested for alleged rape and spent that night and most of following day in a police cell. I was interviewed and later released without charge. My turmoil only lasted a couple of days. No crime actually happened and it was made up by a so called friend who came from a public school education and in fact has never had a job. I then find out from the same village someone who had heard that this had happened before ie she alleged rape on a previous occasion.
So she is a Serial False Rape Accuser. No further action was taken for wasting police time. I read alot that this is the norm but why when its at least 2 false accusations do the police not do anything.
The police are not worried about lives being wrecked or inconvenienced. Yet up until that point you have been a law abiding citizen and you want to help the police catch criminals and the like but hey why bother when you dont even receive an apology for the event that never happened.

Should have found your forum earlier because I went to a solicitor who got a barristers opinion which cost me nearly £400. His opinion was not very encouraging. The accuser did not own any property.
So slim chance of getting any compensation. I`m sure that her situation has been manufactured.

I have some points that I hope someone can help me with.
Can I get a copy of this file from the local police station? ie statements etc
How do I go about getting these copy files and getting my DNA removed also?
I understand also that even though there was no charge this will show up on a CRB check.
    Is this true?

I do feel for others who`s life has been turned upside down going through days, weeks and months of not knowing - mine was only 2 days.
    Excellent forum. Thanks

    Hi Hooked.

Firstly, can I ask which solicitor you spoke to who charged you £400?

To answer your questions...you can't get the statements from police unless you are charged, which you weren't.
To get your DNA removed, you have to write about your case to the Chief Constable of the police force involved. Speaking to your MP will add some weight to it. The success rate on this is fairly low I'm afraid but as you were NFA'd very quickly within days you may well have a case for getting this converted to a No Crime. When you have made 10 posts and been here a certain amount of time, I will be able to send you a Private Message with some documentation relating to getting a No Crime. Please contact me to remind me. Again, the best route is to write to the Chief Constable laying out the reasons why you should have your case No Crimed, preferably with the backing of your MP

Finally, it won't show up on a standard CRB but if you ever need an Enhanced CRB, it is likely that something will show up in the additional information section. Goodmans are a solicitor firm who specialise on trying to get this unwanted information removed from the Police National Computer. You would first need to obtain an ECRB...the cheapest way to do this is to volunteer somewhere that requires one and a copy will be sent to you.

      Something I wonder..

If you fight the FA and try and go down the civil prosecution route, will there be disclosure then?

Hi Hooked, sorry to hear your story and can understand your questions.

Yes that irked me to. Ny fa was never charged, gross incompetence from beds police, the whole thing was a pantomime. Make a complaint through the police professional standards and insist on a no crime. I did this and it worked. As for dba removal no chance. I have had three crb checks and none showed it up.

Quinn, if you have an ECRB check you might find that the allegation will show on that.

Mine both were extended. The only thing was the length of them. Both were 4 months to come through, compared to less than a month for others who work there.

I think RF meant an enhanced CRB - they go into more depth.

Quinn, if you work with children or vulnerable people you will need an Enhanced CRB as RFLH says.

On this, there is a box titled 'Additional information' where you may well have found details of your alleged offence.

If you have been No Crimed this may have been removed. But it may not have been.

Help and Advice - Falsely Accysed of Rape

                      Hi
                      Many thanks for replies

Faith - I got a barristers opinion which basically said dont waste any money (bit late) trying to persue a defamatory compensation. The solicitors charged me nearly £400 for that opinion. That was then.

I looked again at the letter I received from the police nearly 5 years ago.
It says I am NOT now required to attend a certain date regarding an alleged offence of rape " as there is insufficient evidence at this time to proceed further. However should further evidence come to light the right to reconsider the position is reserved." Is this the same as NFA?

As I am self-employed I cant even get a CRB for myself so will have to volunteer somewhere and see what it throws up. Presumbably a Basic CRB is all I need or do I want to find out more (ECR

Not to worried about DNA on file if its that difficult to get removed.
I suppose thats why the police love false rape accusers - they get some DNA on file.

                        Yes that is an NFA

You would need to get an Enhanced CRB to find out what it throws up truly.

It may still come up. It would say what you were charged with but SHOULD point out that you were acquitted.

I often wonder why there is a CRB and an ECRB... Why not just one that covers all???

Cash cash cash... Does it make kiddies any safer? Nope... Does it attempt to force people to follow rules? Yep...

                              Money and control.

It sucks big time though if you find yourself falsely accused. It can literally ruin peoples lives and for little benefit.
                              Wow... A signature option!
