  • Trial date approaching !!!!

    The date for trial is early October... I thought that i would feel relieved once we had a date , instead im beginning to panic,and im worrying myself to the point where i am not sleeping well.

    Even though i have faith in Max and Emma, i find that i am constantly worrying about the WHAT IF'S...

    we have asked the court fees to be looked at again, as THEY ARE ASKING FOR MUCH MORE THAN WE CAN POSSIBLY AFFORD !!!! even though the trial starts in 7 weeks, we have been advised by Max, not to pay anything....Now i find my self panicking in case the worse happends and im alone with my 3 children, and court fees are owed...The house is in my sole name,and we are not married so, im praying that our home will be safe !!

    This question (court costs) came up recently, though I can't remember who's thread, so can't link to it.

    The consensus was that, though the court bailiffs will probably write to your address with a demand if there are any outstanding costs at the conclusion of the trial, the debt would be his and you aren't responsible for settling it (unless you wanted to)

    Don't worry about this just yet though; concentrate on him getting the right verdict!

      Thanks for your reply Casehardened... im trying hard to find some positivity again...the feeling of guilt is overwhelming me at the moment,as i feel bad for worying about financal things, when he is facing trial soon

        After Mr Saffron was convicted (but before he was sentenced) we put every asset into my name. House, car, etc. Unfortunately he had quite a lot of debts too so we arranged to cash in a life a insurance policy to pay those off. We were very fortunate that my Dad is not a poor man (although not particularly wealthy either) but he was able to assist us financially in terms of nursery fees for our son, so that I could carry on working and therefore be more or less self-sufficient. My husband also wrote to his bank giving me executive power over his financial matters. This meant that I could sort out direct debits etc myself, without him having to sign things.

        At sentencing our (cr4p) barrister told the judge that no costs should be paid by Mr S as he had lost his job due to the allegation. He also said that Mr Saffron had taken up minimum-wage casual work, which, while a credit to him, did not provide him with the means to pay any costs. The judge agreed with this and ordered that no costs should be paid, despite his Not Guilty plea. As far as I understand it, this is pretty unusual.
        Even more unusual is that Mr S was not required to sign the SOR. Unheard of in fact. Even RF has never heard of this, but it's true.

        Anyway, I am wibbling. What I am trying to say is that, whatever happens, you will find a way through it. Good luck

          If you are/were living together then your income and/or property would be taken into consideration I believe when it comes to public funding.

            Thats what i'm afraid of Rights Fighter!!! its so unfair....so if that happends, and if he is found guilty, i will have to sell my house, and pay the costs....that will leave me with nothing...and ill be homeless....................great

              Do you have anybody you trust enough to sign it over to so they become your landlord?

                  I find it incredibly odd that they remove the right to provide your own defence (force you to have legal representation) and then massively overhaul the sexual offences act so that virtually anyone can find themselves facing court accused of a sexual offence...

                  It is my belief that where you are not allowed to defend yourself in court the legal representation should be free.

                  The current system to me is draconian and unfair.

                    My contributions are 100% of my income which was rediculous, which was agreed by my Defence.

                    It's a horrible, terrible situation ally because of a false accusation.

                    I've been the same, not sleeping again etc.

                      This situation seems so unfair but the people on this forum will give you good advice. I hope you get through the trial and the right verdict is reached. Stay strong and be there for each other.

                        I know that this person leads a very normal life, but is trying to get out of giving evidence in Court!!

                          Are they claiming to be too ill to attend or something like that, brokenman ?

                          I'm not an expert but I thought they had to provide medical evidence of this ?

                          Can your side not have them examined by a medical expert ?

                          Is there any way you can gather evidence to support the fact they are leading a normal life ?

                          Different situation but I used to work for the DSS, and the fraud department when they were investigating someone took photos of them working/ jogging, lifting things, going into the local gym etc. to prove they were lying about their health issues ?

                            No not ill or anything, just the bulshie that @&£( can't think straight and gets her words twisted being in a public forum etc etc.

                            I've been up since 4am with not being able to sleep!!

                              My accuser leads normal life too, but on the day when she suppose to give eveidence she played and she said that she know what is my defence line. on the first day in the court, she send two of her friends( i cant prove it) but the next day on the way to the court in the unmarked police car, she said to her friend (witness) that she know our defence line!!! day before, her friends where sitting in the court room and listening everything. After all, one of them ;left the court room, and i assume she went to inform my accuser what is the defence line. She know that she will be f.... up, cos she was saying that she dindnt talk or text (and many more)to me after the ''rape'' which was not true and I could prove it.
