    yeah they have seen in CCTC already and the girl has said that passenger was talking to her and she also described how he look like which is exactly match and she also descrbed the driver and that is me.

    now just have to wait for forensic results which will prove i did not do anything. but wondering if it happens that will i get NFA because my involvement in rape in nothing or the case will be carry on because passenger raped her and in my car when i m stading outside?

        I just want to ask a question from all of you.

        can you get charge for anything? if someone had sex or rape in your property like my car? if the owner dont know wheather its a rape or just consent sex?
        like i had no idea what is the age of a girl? as found out after that she is 15.

          they could try for aiding and abetting - but nobody can answer this question definitively.

            it is 100% that u get punished or you can get caution or community service if you background is clear with no conviction.

              only a judge can determine the length of a sentence. There's no point worrying about something that may not happen - this is now a waiting game to find out.

              Some questions are impossible for us to answer - this is one of them.

                hey people's

                have you ever heard anyone got sentence for letting anyone had sex( not sure, if it happened) in the car or in property? as the driver of a car, i didn't know she was 15 years old and i didn't had no contact with her. like i have told earlier, it was a passenger and forensic results will prove it. but i am worried.

                do you know or heard anyone got punished for doing that what i did?

                  This question has already been answered as best as we can. As RFLH has said, there is a crime called aiding and abetting which they could try for. But without knowing the full details of your case and before it is established what happened in the CPS's case we can't make any logical guesses as to what awaits you I am afraid.

                    hi all
                    the bail conditions is, not to meet the passenger who raped a girl.
                    yes he was acting normal and scared when he finds out the girl is 15 but i m not sure.
                    we were texting after that incident on the same day because he was scared and i was texting him that, you did not had sex with her so police won't do anything and police only take action when its serious like rape but you only kissing her and stuff, so it wont be a big problem.

                    but God knows, if they had sex or not because my car windows are tinited, can't see inside. but car wasn't moving at all. so i dont know.


                    today i received a letter from my duty solicitor

                    it states that, in order for the prosecution to prove this offence against you they must prove that you along with another male forced a 15 year old female into your car and where one of you raped her

                    " as no one forced her at all, form CCTV camera,it will be prove that passenger was talking to her and to get in the car, she jumped from the railing. so she willingly got in the car.

                    she might be lieing that she was forced?

                    it also states, following the police disclosure and your instruction to me, i advised you to continue to answer the questions in the police interview because you were strongly denying the allegation. your instructions to me that the passenger told you, he knew the girl and he invited her into the car. you did not know the age of the girl. you also stated that the passenger and the girl might had consensual sex in the rear of your car but you are not sure.

                    " that is true because i didn't talk to her, i didn't touch her and i didn't do anything with her and i am not even sure if they had sex."

                    it also states that, based upon the information the police has given us so far, our view is that the prosecution case is moderate because of the available evidence to-date

                    he also advised me, if i didn't do anything with the girl then i should never feel guilty.

                      Did you tell the police in interview that you texted the passenger? If you did, I am rather surprised that they did not seize your mobile phone. I would ask the solicitor to look after the phone for you until you know the outcome. If you are charged then the sol can get the phone forensically examined.

                      If you hand it to the police now they might 'lose' it and then claim they were never given it. It would not be the first time I have heard of the police doing this.

                        no. police only asked me the time when the girl was with us, did we speak to anyone over the phone and i said no.
                        i texted the passenger later that night.
                        when police came to my house, they seized my phone, clothes and other few things and my car too.

                        today i rang the cops who dealing with my car regarding for my car, he said, you can call me end of this week and will give me information about car and phone, he said, had send to forensic team for full examined and my clothes, i will get it after car and phone.

                        the friend was scared because he didnt know the girl is 15 and he was with her in rear seat of car.

                            Ah ok, Sorry my apologies, my mistake, I thought this was before the police were involved. So the police already have your phone I take it.

                            There really is not much you can do but to sit it out and wait. I realise that won't stop you worrying but I cannot think of anything else you could do to help things along. Obviously you are no longer in touch with your 'friend' in any way, now. Not even texting. He's not your friend as he has tried to pin this on you. I do hope you have real friends around you (or family) you can talk to.

                              did you read me other post, i posted above, saying about solicitor letter.

                              if he did something wrong, he should have accepted it but if he didn't then should have tell cops that he was with the girl but didn't do anything. atleast i wont get in trouble for doing nothing because forensic results will prove everything.

                              i want to ask a question, i was doing some research and read it that, CPS only forward those cases, where they think they have 51% chances of winning? duno if its true.

                                Yes I read about the solicitors letter. I am in the middle of reviewing an appeal against conviction at the moment so cannot answer everything as I don't have time. Just the word of the accuser can be enough to proceed.

                                Yes CPS will proceed if there is more than 50% chance of conviction regardless of provable guilt or innocence. That has been proved time and again. The trial I attended at the end of July should never have got passed the CPS.
