accused for suspision of rape

    As I said in an email an appeal can take anything up to a year (and more). First we have to review the trial papers and also have to find grounds to appeal and then go from there.

    If we have grounds then the case will be send to the "Single Judge" (in London) to decide whether he agrees with the grounds and gives leave to appeal.

    If he gives leave we then have around 6 months to wait for the hearing. Sadly it is VERY time consuming.

    It's good to see that your brother is continuing with his studies

    • Just to update. We have a few grounds with which to appeal - linked to each other too which makes them stronger. I cannot say what the Grounds are as this is a public forum and obviously anybody will be reading this including police and CPS, but just wanted members to see some good news for a wrongly incarcerated falsely accused person.

          • I seem to have missed all this ( busy with a breakdown) at the time.

            I really hope the appeal is heard soon and brings a fair result. I can't imagine the nightmare of such a sentence for SO or his family when they know he is not guilty.

            • Well over a year. The grounds have to be perfected and sent to the convicting crown court who then send to RCJ in London. We then wait around 6 months for the SJ (Single Judge) to decide whether he will give leave to appeal and then another 6 months or so for the full hearing if all goes well......

              • Great news about the grounds for appeal, but a disgrace that everything's so slow. I hope he's keeping as well as possible and continuing his studies.

                  • It's about a year if everything goes according to plan with no hiccups. Sometimes things can take longer....... fingers crossed. I've had the draft Advice and Grounds - they need to be checked and double checked ergo 'perfected'.

                      Well... It should be, being a woman and all.

                      Okay, light hearted humour aside. I couldn't think of a better lady to be trusted with the looming battle. I wish you and the team outright success and if it takes a year to get our man back then a year is what it takes. It's a long time but I'm hoping for positive results.

                          Ah... But if you weren't on here then the connections wouldn't be made...

                          There may also not have been enough confidence in the capabilities of a complete stranger for an appeal to be considered by the family/stressed out.

                          There are a million reasons why you should take at least 50% of the credit. The initial connection is just as important as the result.

                            I hope that you guys are well, It was such a relief to hear that the grounds for appeal have been identified, I was able to read through the grounds document and was able to explain it to the family.

                            Although it's a long wait as Rights Fighter mentioned, but my brother is try his best to keep himself busy. Since they believe that he's over qualified to carry on with his studies, he's teaching Maths to other prisoners.

                            Thank you everyone for all the support you provided me and my family with, it has been a great help

                              This is great to hear; a case of positivity over adversity perhaps? He could make huge difference to their futures when they have served their time as well as making his own ordeal slightly more bearable (enhanced status & privileges?)
