    • If prosecuting made up part of the story as you say, and what was said does not mirror what anybody else says, then if it goes horribly wrong you might have a ground with which to appeal.

Please take note of the thread that refers to the 'nasty bag' so that if you are convicted, at least you will have things to take with you.

It sounds as though you did very well. All we can do is to hope the judge sums up fairly and that the jury have more than a brain cell between them.

      Take care

      • Thanks for ur replies back.

I really hope and pray that it will turn out not guilty verdict.

But I also need to keep it in mind about negative.what if it's comes out guilty.

What will happen next? Will I be sentence or will they keep me on remand or let me go home.

        • Hi Stressed out. It does sound like you did really well - you told the truth, stuck to your statement and put her straight when she tried to steer you off course. Well done!

It's impossible to know in advance with juries - It's for the prosecution to bring evidence which proves that a defendant is guilty, not for the defendant to prove his innocence, I wouldn't have thought that there was enough there to convict either of you, but it's impossible to tell in advance. The forensic evidence neither proves nor disproves anything. Even the fact he initially lied can be put down to fear etc, and as has been said, he could be found guilty and you found not guilty.

If someone is found guilty, they can be sentenced straight away or at a later date (eg in a few weeks). You need to talk to your barrister about this. Have your bag ready by all means but hope for the best. I actually bought my boy some of the things it suggests in the prisoner's guide without telling him and packed the bag but didn't have the heart to take it with us on the last day... I appreciate it's a difficult time for you. Hope and pray for the best , that's all you can do now. I actually think you've done well.

Now go and enjoy yourself for at least part of the week-end.

            • thanks for your replies.

may i ask some sort of information if anyone ever went through it.

when jury go and make a decision, what sort of stuff they need to keep it in mind while making decision?

if the jury is not sure about something, what can they do about it?

last thing, when prosecutor asked me questions, she was basically accusing me and telling me that i am lying and she said, that would have happen. she asked me more then 25 questions but i keep saying no that is not correct and then i tell her, what exactly happen and told her in explanation and it does match my first ever police statement and my defense statement.

I don't know if i did it right? or should i only said, no that's incorrect and wait for her next question.

              • It sounds like you did it just right. I think you're thinking too much and trying to get into everybody's heads again. If the jury isn't sure about something, they can ask for a point to be clarified and ask for guidance from the judge.

The jury aren't fools though, they should be able to tell when the prosecuting barrister is trying to intimidate a defendant and make him say or admit to things which didn't happen. It can backfire and make the jury sympathise with the defendant.

                • Sounds like you did very well there, I have said it before it is easy to tell the truth. I think it can only be a good thing that you corrected her accusations with what actually happened.
Hopefully each juror will see that you were being honest.

This will be a long weekend but I pray for a positive result.

                    • thanks for your replies

i am very scared for going tomorrow but i have to face it. spoke to passenger, he said his barrister have spoke to judge, i was there as well but i couldn't hear it.
he said, if the passenger got convicted of rape then i should get convicted as well for aiding and abetting rape but i spoke to my barrister, he said, its a different case.

that's not fair on me but can't do much about it. hope i get not guilty.

if you didn't hear anything from me tomorrow then that's mean jury found a innocent person guilty

i got my nasty bag ready just in case, wrote few letters so when i am gone, family can read them and cancel my insurance and few other on going bills.

i am sure the accuser will be so happy.

                        • Hi stressed out, I'm surprised at the passenger's remark - it's not up to his barrister or the judge to decide whether you should also be found guilty or not... that's what the jury's for.

Will be thinking of you tomorrow and looking forward to a positive outcome.
