Hi there,
I am sorry to bother you with my problems, but i really need some advice this it driving me mad!
About 4 weeks ago i was accused of rape... I still can't believe it to this day!
Anyway I went to the pub with a few mates and my uncle, I saw a friend of a friend and he was with his sister, i didn't really chat to them, Just a quick hello and carried on as normal. We changed bars and they followed about 30 mins later. After i asked who she was and my mate informed me that it was his friends sister, and that she was a lesbian so not to bother chatting her up. Anyway we ened up in the final bar again having had a few drinks i can't remember if we chatted at all but if we did it certinly wasn't more than a couple sentences the whole night. In fact i spent most of the night chatting to a frineds GF and another girl who i was chatting up.
After walking out of the bar i saw the sister standing outside and asked if she's seen anyone as i was looking for them as they were going back for after drinks. She turned around and asked "if i come home with you will you f**k me" shocked i asked i though you were a lesbian to which she replied "well that doesn't mean i don't miss c*ck, so will you f**k me. Stupidly the oppertunist in me said well why not, never look a gift horse in the mouth.
I ordered a taxi and she complained it was taking too long, so i called them again. finally it arrived and she got in completely unprovoked by me and we went back to my parents house, on the way we stopped and i got some ciggarettes while she sat in the taxi, when we finally did get back to mine she was on the phone so i went in while she finished her phone call, my mother looked out the window and saw her but not me so when she came down stairs to see who'd just walked in, when she realised i was there she tried to go back upstairs but the dog ran through and i realised she was there, unfortunately when we got in the girl had started talking dirty and said "i want your c*ck"
Mortified that my mother had heard some girl i had brought back say this, i said "just ignore her" she insisted and pushed past to say hello, she shook my mothers hand, awkward!! anyway my mother went back upstairs and about 10-15 mins later she unzipped my pants and started to perfom oral at the kitchen table. (I was staying in the living room as my uncle was visiting and had given him my room.)
we made our way to the living room and we were both naked and in the middle of sex she was saying things like f**ck me harder and cum in me. after we were finished i went to get a glass of water and she had been sick (at no point through the night had she seemed that drunk, she wore 5" heels and walked perfectly and was chatting normally) i helped her up and cleaned up the sick and when she came back she was crying, apologising for making a mess and embarrassing herself. i handed her, her clothes and she got dreassed entirely on her own, i comforted her and gave her a hug and called her a cab to which she refused and walked home, i even gave her a kiss good by and she seemed happy enough.
i thought it was all over, the next day i went to the pub to watch the rugby and when i got back 2 police men knocked at the door, and informed me that i was being arressted on suspicion of rape. They took a statement on the scene which was very short and had a forensic unit inspect the living room and bathroom. I was kept in a dry cell and intimate samples taken (embarrasing!!). After i was returned to my cell the came back and asked to check my back and nothing was there, one of them commented "well there's method in her madness then". Finally the next morning, i was interviewed after i had my duty solicitor present and gave a full account of the event pretty much as mentioned above. i was released on bail and am due to go back next sunday.
They went to the local pubs where i'm well known and said CID are looking for me and can they see the CCTV footage, so it's a safe bet that half of the town knows something's up.
After about a week and a half they phoned one of my friends about the evening, and he asked if he could give a character statement and explain that there was no way in hell, to which the detective said "thats the overwheming impression we get".
Now it's been 4 weeks and still no NFA letter and as you can imagine the closer i get the the date the more nervous i am getting. 1st off i can't believe that i can be arrested and have something stay on my record purely on some womans say so, and thats without being charged.
Everyone i've spoken to has said that it sounds completely ludacris, but after speaking to my lawyer i can see that the law system is far from just.
i can't personally see how she has a case, she came back to mine on her request, i forced nothing, when we came back i only did as she asked and with the there was my mother, grand mother and uncle asleep upstairs, aswell as ordering her a taxi home, but still i'm sat here waiting, what do you guys think? As you can imagine i'm Sh*tting myself. I ave always done well with women and am known as being a bit of a slag so i can only imagine if this goes to court that it will be used against me. Infact the night i was arressted i was meant to meet a girl i met in london a few week previously so it wasn't as if i needed to do anything, it was merely that she offered it on a plate that i did anything, would this be worth mentioning or would it most likely be used as a negative.
I have contacted a solicitor to go with me and he seems pretty confident, but my stomach turns everytime i think about it and was hoping you guys could offer some insight.
what advice do you guys have and is there anything i should do before next sunday in preperation?
Any Info/Advise you could give is greatlllyyy appreciated.
