The presumption is for bail to be granted unless there are powerful reasons otherwise: other reasons being that the accused has been previously arrested for similar offences; there is a danger of the accused influencing potential witnesses; or is in personal danger from witnesses or accuser.

Obviously if any of this applied he wouldn't have been granted police bail in the first place so it is fairly certain that he will be rebailed with conditions.

PS The solicitor will apply for legal aid on your behalf if this is necessary.

The fact that your solicitor has said you will be required to apply for legal aid is not an indication of which way your case will go at this stage. It's a necessary warning for you to be prepared and standard practice.

With regard to her making previous allegations, the police will still investigate thoroughly - Tony was number 7 at the start of his 16 week ordeal on bail for FA. By the time he had his NFA there was an 8th - and that guy was on bail for even longer.

Even though I'd been following Tony's case, I'd missed out on this fact.....unbelievable!

The supreme irony is that if say, she'd been caught making false insurance claims, by No.2 or 3, she'd find it quite impossible to get cover.

Thanks to everybody for your replies! The more I hear about this "woman" the angrier I become. Havent seen this other woman yet to see who else this was supposed to have happened to, but I was talking to this guy at work and he said " a few years back,I was working at shop and she was always making these sexual innuendos at me( come round when hubby is out,we can have great sex!")He was only 15! She also propositioned his cousin at a dance, when he turned her down, she told her hubby he had tried to grab her and kiss her! He was 17. She also tried it on with my son when he was about 16 or17, but I unfortunately took it as a joke at the time and forgot about it. And she can get away with all this? Afte r all this and thinking about it, it is now getting clearer in my mind what happened, and the timetable. She came round to my house, hubby took her home-paralytic.She comes back round to ours accusing him of raping her at 2am,he shows her out, she then rings her hubby, who has to come home early from the job he has just started at ( my brother said, he works at same place) he calls police, she puts onFB "off to bedxx", goes! Police wake us up at5..30,but she is allowed a lie in, as am told she didnt go to police station till 8am - 1pm no video statement, no dna as she was too tired! Then puts in for amove! Not too tired for that! Heardso many stories about her, she needs moving, locking up and the key thrown away!Nobody believes her!

Would like to ask, as there seems to be a bit of conflicting advice, do we need to have a specialist solicitor on hand for when my hubby goes to answer bail on 17th Aug, or rely on duty sol til we find out if he is going to be charged? Have googled it, but being a rural area, only 1 came up that included sexual charges as being experienced, think they offered 15 mns free advice, is this good or not? But not very computer savvy! It's not really conflicting advice as much. More that you should prepare yourself for requiring a specialist solicitor. If for example, your husband were to be requestioned when he answered bail, it'd be useful to have a specialist solicitor there. If he is NFA'd or rebailed without questioning, chances are that he won't need a solicitor in attendance at all

The advice we always give is to get a specialist on board asap.
However, it's not the end of the world if a duty solicitor answers bail with your husband...so long as you have a specialist lined up for if a charge comes. Obviously, the earlier the solicitor you would instruct is in place, the more savvy they will be with your case.

Hello everyone. A quick question if I may. My husband goes for his bail hearing on Friday. Does anyone know if the accuser would know the outcome of this (i.e. re-bail, charge or NFA) before my husband, and if so how long in advance would she be likely to know? Thank you

Yes the accuser will be informed of this...and it is usually before the accused.

Generally, I would hope that the police would make every effort to inform you as soon as possible after the accuser or any outcome. it wouldn't be nice to hear any result, whatever it may be, over the grapevine.
I am sure they are probably advised not to make contact with you...

My husband had a phone call off police today, to say that he is being re bailed for another 4 weeks, as they havent had the forensics back yet. Its been 8 weeks - surely they should be back by now? He has been trying to get hold of his duty solicitor for 2 days now, to no avail. The secretary says he is in court and will ring him back, but he doesnt. We have a couple of important pieces of information that could help my husbands case and want to tell him. My husband hasnt spoken to him since the day he was arrested. Now he cant come home for another 4 weeks at least, then they have to send off their report to the CPS. This is a real nightmare.
