Refund of legal contributions and expenses

Hi all,

I would like to enquire if anybody knows how long it takes for the Legal Services Commission to refund my Legal Contribution after being found not guilty? Rossendales, the debt collectors, informed me that it can take up to 6 months for a refund and on their records they have not yet been informed of the outcome of my trial. I paid over £5,000 in contributions and of course would like that money to be refunded. Can anyone speak from experience here?

Also the court agreed to refund me for expenses (travel, accommodation, loss of earnings), which were quite high. I completed a form sent by the courts to my solicitor and returned it a few days ago. Again if anybody has any experience on the length of time it takes to be refunded here, I would be very grateful for any information. I did not want to disclose my employers name and contact details on the "Loss of Earnings" section for obvious reasons, but included a payslip (with my employer's name blacked out). Could this be problematic?

We could claim for false rape accusation,but I don't care.The most precious thing is freedom.
I won't claim for the coffees I had in Crown Court...

Thanks mate. Agree that freedom is the most precious thing, without doubt. All those additional expenses have actually accumulated to almost £2,500 and my lawyer advised me to try and claim back as much of it as I could. So that's where we stand, may aswell go for it. Thanks again

You cannot claim for 'false accusations'. Many people who are found not guilty are in fact factually guilty - they have committed the offence(s) which is why there is no automatic right to claim for being falsely accused. That would come under a different action and would have to be proved. A not guilty verdict does not prove innocence any more than a guilty verdict proves guilt.

You can expect to be paid between four to 12 months depending on the court/services and how fast they process these applications in your area.

1:About the suits,I was just making an example of a list of all the things you have to buy and spend when you have to go to court when before some of these expences would have been unnecessary.

2 I only wish we could just for the trauma resulting by these false allegation

3 It is a fact that just to go to Court means that we commited the offence,I don't deny it but it is too easy to claim for rape when sometimes it was consensual or provoked.

Next time I'll post something I'll have to think a bit more about what I write and my vocabulary.

Sorry I don't mean to be harsh - I tend to say it as it is and as I am sooo busy on another trial I tend to type quickly and speak simply as I type.

I know some guys buy suits specifically for court but LSC (Legal Services Commission) would say that you can wear your suits afterwards. That is fair if you think about it as otherwise you'd get defendants buying Armani suits expecting to get reimbursed for them!

You are absolutely right as well, when you say it is very easy for somebody to make a false allegation of rape.

It is a quality for you to be harsh,on my thread you wrote:

The police will say "oh that's convenient you have only just thought this one up".

Even if you had told them this at interview they would have said "oh really? Where's the evidence of her saying this?"

When I had my trial,the prosecutor told me exactly this:that I was inventing this story in order to escape.
Even my barrister was so scared because I wrote this one week later,and it was my word against hers.

I respect you RF because you are harsh and I feel sorry for people who are offended by you.I have 2 people at the moment in my mind the priest and Mark.
Compared to the barristers you are a lamb of God.
If they knew and everyone who read this what will come next they should take your words and advice for granted.
