  • Could this help?

Sorry I keep posting... I'm impatient!

Anywho, my bf has sent loads of evidence to his solicitor (all backed up) but because he wont see her till next month I just wanted to ask peoples opinion on wether they think it's useful or not.

The prosecution claims after the last "rape" they broke up for good but we have evidence that they still dated for at least another 4 months (and most the time she asked him if he wanted to come over, go to lunch ect not the otherway around) when they actually did brake up she started dating someone new the same day. (we have evidence of this) and she claims she couldn't tell the police at the time because she was to traumatised, yet we have found about 100 pictures that show otherwise.

If you have evidence that she stayed with him four months after the last rape then that could potentially be useful, dependent on the circumstances.
If she is claiming that after she was raped she left him because of the trauma and then that turns out to not be the case it could undermine her.

On the other hand, if there were many 'rapes' and she is not suggesting that she left after being raped, prosecution would argue that she got the date wrong by 4 months.

Best to await your solicitor's view. Can you not ask via email/telephone?

I don't disbelieve that she stayed with him for 4 months

I think that as your solicitor is the legal expert and knows your case better than us all, then it would be better for them to tell you whether or not it would be useful in court

Yeah I know, but don't want to bug solicitor... we sent a hell of a lot of files so I'm sure she has not gone through them all yet as she will have other cases to deal with. So until then I was just seeing if anyone else who has been to trial has used any similar evidence... just want to make sure i'm not wasting time. Uni break rather sucks, nothing to take my mind off it, other then the gym!! (gee I'll be a size 4 by the end of summer!!!)
