  • i need help

    ok i met someone online, and we got into a hot and heavy , bdsm style relationship, all was well for 8 mths till i found out she had been seeing other blokes behind my back so i ended the relationship, one month after i get a knock, but am at work , so im asked to go into the police station which i do , only spent 2 hours in there but waved the right to legal council and handed over my phone, i was totally scared ive never been in trouble in my life, i wasnt arrested or charged , but that was 12 weeks ago i keep ringing the officer in charge of the case he keeps saying he's not had time to look into the case yet, can anyone tell me if i did the right thing, thanks.......

    Hi,

    I presume that as you have posted up on this forum the allegation against you, and what you were interviewed about, was one of rape.

    If so, and you weren't arrested or processed (swabbed for DNA, photographed, & fingerprinted) and bailed then I would say you haven't too much to worry about.

    If say, you were actually guilty, there is presently no legal reason to stop you leaving for a non-extraditable destination, therefore I'm guessing the police are fairly certain the allegation made against you is malicious; quite possibly the woman is known to them (may have made previous allegatins?)

        Unfortunately it was perhaps a mistake to to waive your legal representation. As for handing over your phone, did you offer this? They won't have been able to seize it without arresting you or without a warrant for it?
        If, 12 weeks on, you haven;t been arrested, and he's still to 'look into it' it doesn't sound as if they're taking it very seriously but take nothing for granted.

          i did offer my phone, and the names of other people who would validate my story, as i, at the time thought it best to comply with everything i think i was in a state of shock to be honest i never saw it coming, and yes i was allowed to leave at anytime, but i stayed until they told me the interview was over, i told them everything and was complitly truthful, in fact the last time i spoke to the DC i said am i gonna be arrested anytime soon he said no, but if we need you to come in if anything needs clearing up would i and i said yes, ....

            If someone is told to let sleeping dogs lie, it means that they shouldn't disturb a situation as it would result in trouble or complications..................................... .................................Leave the police,don't call them trust me they don't want to help at all.Also try not to panic.Other main thing is not to talk about this to much untill you get charged and need a lawyer because anything you say if you do get charged can be used against you.Yes trust me never speak to the police without a lawyer.

            I just won a courtcase against the inspector of police in my city it was one of the finest moments in my life this last friday (unfortuantely it was nothing to do with why I am on here) BUT I SAW something amazing the stupid horrible police who if im being murdered I don't want them to come help me because i feel they are good for nothing well 90% of them (I really hate the police they have picked and bullied me MY whole life because i am the son of immigrants and my country is very racist and other countries say they most racist people) in court they can't be bullies the judges are very smart and judge you fairly where with the police you are guilty straight away................don't contact the policeman maybe he is to busy eating doughnuts and bacon so you never know good luck let's hope nothing comes of it

                      thing is as i was being let out of the station , the other cop did say as i asked what he thought and i qoute "if it looked **** for you we'd be arresting you " and with that he opened the door, and let me out, and its 13 weeks on tuesday, and i've heard nothing, all i want to do is sleep again ,

                        trust me there is nothing you can do besides not worry as much as possible and get on with your life.because you may never get charged and maybe in 1 year you will still be worrying for nothing

                            Arrest - legitimate

                            I am curious about the proportionality of arresting someone who is accused of rape without any evidence except the say so of the accuser, especially if they voluntarilty and promptly turn up at the police station when they are asked to. Any comments on this one??

                              You're arrested on 'suspicion' of 'xyz'. I voluntarily attended and never left until the afternoon the next day!

                              There doesn't have to be any 'evidence' just the complaint. The Police then question you in the hope that either you admit to 'xyz' under questioning or make big mistakes with your version of events. It's a complex question to answer but basically the less you say, especially with regards 'details', the less likely you are to GIVE them evidence. Remember, you don't generally know what the accuser has said so even your special detail (the saving grace in your opinion) could be the thing that ends up getting you charged.

                              The Police are supposed to have an open mind and merely gather information to piece together a serious of events. As you confirm what your accuser has already said it pieces together a substantiated story line. The more details you give the more they piece together whereby at a certain point they will most likely have enough to bring charges when the only thing left open to question is the actual committal of the offence alleged. It could be that your version differs greatly from your accuser whereby the Police are no further forward of course........... And about twenty other possible scenarios................

                              Basically, if you attend voluntarily then expect to be arrested and be thankful if it doesn't happen.
