Even if they could not communicate verbally they would be able to communicate 'get off me I don't want to do this' with a poke in the eye. Or similar - if you get my drift.

If you know they cannot communicate consent then surely you do not make a request for sex anyway.

Just because somebody has BPD or has a form of Aspergers does not preclude them from being raped.

In fact they are more likely to be at risk by virtue of the fact that they are more vulnerable than most people.

I would look for a different line of defence if I were you.

I want to know of another cases where mentally ill women are intact crying rape ..as it will explain a lot of things..

She is a mentally ill girl. She told you what she didn't want to do and you penetrated her body with an object. You say this is a FA and that she is crying rape, but you have admitted to doing it. Its not some plod fit up, YOU shoved a carrot into her and she told someone that she didn't want to do it.

I thought I should re-read the OP as I had forgotten what this 'story' was about in full. Yes, she told the OP she did not want to be penetrated with a foreign object in her anus. It seems you talked her into it regardless of her feelings on the matter. Possibly she submitted as opposed to giving consent.......

The pictures might be the elements that will save you if you took them during...but not before or after.

also i think my detailed version of events is corroborated multiple times -- her version of events contradicts some of the texts like she claims i tricked her to go back to mine whilst there is a text messages considering that option.. she accepts to kissing ... she will also have to account for a phone call she got where she answered saying everything was fine everything was ok ...

u tell me if one is raped there will be at least a little something on ones face showing u r unhappy == just after a alleged rape u would smile to let him take naked pics and pose for him ..--- and wld u let the person who allegedly raped u drop u back -- come on give me a break ..

ok please throw possible twisted questions at me -- and ill answer , i have a clear conscious but its not enough in this justice system .. .. i thought the law was in safe hands and could be trusted but it all seems dodgy == i got other feedback which claims the absence of consent has to be proved beyond reasonable doubt but it does not look like it
