I endured about 7 hours of absolute hell the worse period in my life Jury was called back 6 times and asked questions then said they could not reach a verdict.I was so upset I could not speak crying and felt ill afterwards.So looks if I have to go through it all again.Now I am really frightened.I have got more evidence .now it is small pieces but it does cut through more of the lies she has told.

Does anyone know if we can use witness or complainants testimony in the first trial to show they are lying in the second trial.After all it was a statement given under oath and should be heard

I don't know the answer to your question about whether you can use testimony from the first trial in the second but I would look on it as if you were sitting an exam.

You've done the 'mock' exam & now know what questions you will be asked and more importantly your barrister now knows where your accusers weaknesses are and can probe deeply at these.

Hopefully the Crown will relook at the case & offer no evidence the second time, but best to stay strong and be prepared. The positive is that half (maybe more!) of the jury thought you were not guilty.

I am so sorry that you have to endure this dreadful ordeal for a second time although as casehardened said you are now aware of all the evidence against you and can be stronger.

Well, it's not the best news in the world, but it's not a disaster either.
As others have said, a hung jury means that at least half of the jurors thought you were innocent. They BELIEVED you.
Holding a trial is hugely expensive. Hopefully the CPS will look again at the case and decide not to proceed.

A hung jury must mean that things really did go to the wire but there simply wasn't enough to convict you. Courts seem to like answers that go one way or the other and you've ended up bang in the middle.

The prosecution must now weigh up if it is in the publics interest to go for a second shot. If the public, via the jury, are saying neither yes nor no then it's going to be a real hard decision for them as it could really swing either way especially now that you are armed with all the details and able to work more rapidly towards providing defensive replies to them.

Hi sadman. The three bits I have highlighted above are questions for you to ask your solicitor.

It is possible to find out if she has claimed compo but if she has, that in itself won't help. What might help is to clarify what she told them in her application - whether what she alleged to them goes beyond what she has alleged to the police. Barrister can put an application in to obtain this evidence.

We will never know how the jury went - whether it was 9 - 3 innocent or guilty or whether the figures are different: 8 - 4, or 7 - 5 o r 6 - 6.

Hopefully the complainant will not want to go through it herself, again.

Hi there, so glad to hear from you Sadman. I'm sorry that it looks like you may have to go through the whole traumatic thing again but it is at least half a victory - and I guess that you now know what the prosecution are throwing at you and in which way.

From what I understand a hung jury may result in a retrial.

It's not automatic.

Nothing is a certainty unfortunately. I would seek the opinion of your legal team.
