  • Who should i give transcript to?

    My Friend has been accused of rape and imprisoning her. i know this is not true as i used to talk to her on facebook and she has said things to be to prove she is lying.
    the history goes back 15 months and i have printed it off. im expected to be called as a witness, but who do i give the transcript to? the police or to my friends solicitor?

    Don't give it to the police H, give it your friends solicitor, it will be good evidence.
    I'd make a couple of copies to and keep them safe.

      100% agree with Izzy.
      To be safe, in case information gets lost, it might be worth taking screenshots of the evidence on the computer as well and saving them seperately.

        Thanks Guys

        As i have over 50 A4 pieces of paper i've took screen shots of the important stuff and let the minor stuff like 'hello how are you' and stuff like that.

        He has a station Duty Solicitor and i've gave him a number of a specialist one. ive told him to call them Monday without fail and make an appointment for a chat.
        It really wound me up cos my mate is so upset and angry and everyone knows shes lying its just a point of proving it isn't it?

          Don't give it to the duty sol either as quite often they have no idea about sex cases and might hand over this evidence never to be seen again.

          I take it you still have this evidence on your computer to and it's not copy and pasted stuff but screen shots?

            Yes it still on my facebook account history and have not deleted it. if i get interviewed as a witness do i need to tell the investigating officer that i have passed on this evidence to his solicitor. i dont want to be in trouble with withholding evidence thats all.

              You would be expected to answer all the questions that the officer asked you, honestly and to the best of your knowledge.

              Not volunteering information that you have not been asked about is not the same as withholding evidence

                Answer only the question - don't expand it to try and explain your answer. The less you give them - the less they have to use against you.

                Ignore the long gaps inbetween questions, the temptation to fill the silence with explanations is always there.

                  As RFLH says, if you get interviewed as a witness then only answer the questions the officer asks you.

                  It's likely you won't be interested in interviewing you if they think you might assist the defence case in any event. If you friend is charged (and the police do not approach you) take proper screenshots of everything, write a covering letter in the form of a bullet point list:

                  !: My name is

                  2: I live at the address given overleaf

                  3: I was concerned about my friend Mr X being accused of 'whatever' so I took it upon myself to do what I could to assist as I did not believe a word of it.

                  4: I decided to search for helpful information on the internet and found the following information which is to be found on the enclosures. (List what they are but do not copy type them - just something like 'screenshot of conversation on Facebook on x date 2012)

                  5: Everything I have said in this statement is true to the best of my belief and knowledge

                  6: I am willing to attend court to support Mr X

                      Hey just to keep you all in formed the lass who said she was raped by my friend is now texting everyone he know and saying he has had sex with they wifes and girlfriends. She is doing this even though the police have told her not to contact anyone who knows my friend. Could this also go for my friend in proving his innocence? Ive told him to call the police and tell them

                        Solicitor First!!!!

                        Everything must go to the solicitor first.
                        Let them decide what gets shared with the police. This is usually minimal.

                        If you went to the police, they will likely just tell the accuser to wind her neck in

                          Make sure that he contact his solicitor before the police.

                          I did give some evidence to my solicitor who told me not to have any contact anymore with the police.

                          So...words of advice.

                            You say that the complainant is texting people claiming to have had sex with lots of other women (with partners). How do you know this? Do you have evidence?
