Please help !!! Fiancee falsely accused of historic rape

    Saw solicitor today, he says that the ex wife is no problem, mental health issues etc problem is the 2 step daughters!!! The only reasons we can both think of are that they believe there mum, and so they are lying through some sick loyalty to her and by doing so giving more ceadence/ weight to her accusations!!! Also the knowledge of compensation!!!!
    It's so hard....

      letter came on Saturday regarding fees !!! we have some legal aid, but they are asking for just under £18,000 which is split into 5 payments....4 x £4,000 and 1 x £1800 how on earth we can pay is beyond me............I'm getting the house being valued tomorrow, and if we sell we wont have enough left to move? ( ONLY BOUGHT HOUSE 4 YRS AGO) and due to recession, have lost 50,000 on it, so hardly any equity .....Mortgage is only £500, and to rent a 3 bed is £1,000 ???? just feel like there is no where to turn now...other half says he will end up defending himself, and will def end up in prison!!!!

      I just feel like everything is slipping through our fingers...our home, our relationship, and even though im looking...i dont see any light at the end of the tunnel

        Very difficult...does the solicitor not work on legal aid or are you just not entitled to the full amount for some reason?

        It's awful the sacrifices that have to be made. Bear in mind that if a not guilty verdict is returned, then you can go on to claim back most of your legal expenses.

        Can you go to any close family to try and help you out in any way?

          I'm sure this was an off-the-cuff comment rather than a serious suggestion, but in fact it wouldn't be allowed (because of the possible trauma to the alleged victim in being cross-examined by her alleged attacker)

          If for some reason the trial started with no legal representation he would be allocated a duty barrister (who would know nothing about him or the case apart from a brief consultation prior to proceedings commencing)

            I am so sad to read your story and I think anyone who reads it can feel your in a lot of pain and you are a good woman.Please take care of yourself

              Been to see our solicitor again, as he had asked that the fees were looked at again as my fiancee is only working 3 days, and im currently unemployed after being laid off on May 2nd. Just recieved a letter, and we only have to pay 5 payments of £250....such a relief !!!
              My fiancee has to appear at the crown court tomorrow morning,and the solicitor is going to ask the judge to direct the press not to allow them to print our full address... I hope to god he agrees, as im sick with worry about our address being given out..solicitor says the judge should agree as people could identify both parties involved and siblings etc; if full address is given out....

              My fiancee will be meeting our Barrister Emma Edhem ( From NO5 Chambers} tomorrow, she has a good reputation and has been successful representing men in historic rape trials !!!

              Trying hard to find strength.....x

                      Fiancée attended court Tuesday, he didn't have to speak. Judge set out a time table, and my fiancee returns on 1st Aug to enter his plea. (should have been on July 20th)The ex wifes barrister asked the judge for more time as it is a historic case, and they need time to find evidence!!!! Thanks for all your kind words!!!

                          The prosecution need time to find evidence??????????? Don't they already have enough for a 'realistic chance of conviction' as they are meant too before launching legal proceedings?

                          Honestly, what in hell is happening to this country...

                          I hope you guys are holding strong.

                          Excellent news with regards to the finances but that's still £1250 too much for defending a false allegation!

                              Hi Mia,

                              Stay strong!! This time last year I was getting ready to defend an allegation of sexual assault at Croydon Crown Court. The reason I am posting is because I was in pieces as well, I was sure I was going to prison. (I didn't do the crime, but thought the jury wouldn't believe me).
                              To cut a long story short, I was accused of a serious sexual assault on a girl with Downs Syndrome, her word against mine etc. It took a year to get to trial and the papers were having a field day with the story, name plastered everywhere etc etc. I did actually break down twice and very nearly made the ultimate sacrifice.

                              My solicitor was Max, trust me he will have your best interests at heart, and my barrister was Emma Edhem, if you mention the trial they may remember. (In fact I know they will)

                              Max was honest and never ever built my hopes up, Emma was kinda scary at first and I think she believed from day 1- which helps.

                              Anyway, after an 8 day trial I was found NOT GUILTY by all 12 jurors, the feeling was total relief and I cried my eyes out lol.

                              Rest easy- you have 2 of the best on your side, and Emma and Max will NOT let you down :-)

                              If you need any advice or anything from someone that has been there let me know- stay strong- Max and Emma will have you sorted :-)

                                Thanks for posting this MATTH.
                                Sounds like a hellish ordeal for you and I am glad that you got the right result.

                                If you have the time, it may benefit our members who are still going through the ordeal to hear your story. We have many members facing trial soon. Obviously, you might find it really difficult to tell your story so please don't feel forced into doing so.
