Apparently she can't remember so that's why its attempted.

How can someone stoop so low???

If she is going to respond to any cross-examination in court with 'I can't remember'
you will probably only need an average solicitor to win the case

Sorry Casehardened, but I don't think that is quite right.
If she "can't remember" the prosecution will argue that she was Unable To Consent - i.e: too p1ssed to know what was going on.
There is a case in court at the moment where two footballers are accused. Throughout her testimony the complainant claimed that she "couldn't remember" whether she had gone to their hotel room voluntarily; whether she'd consented or even whether she'd actually had sex with them. Her answer to all of these questions was "I can't remember".

Plenty of genuine rapes happen when the complainant is completely blotto and therefore incapable of even telling someone their name, let alone deciding whether they want to have sex or not.

I wouldn't be able to afford it. High level as in qualification, there's not much money in our sport.

I am devastated and I am thinking of how to break it to my wife??

Sorry to hear that you have been charged Brokeman.
I feel for you and in my thread I wrote "I won't be a rapist,I'd rather be..."
RFLH wisely answered "...fighting the charge".
I did and I am free.
At this stage you will have to inform someone close to you,you need support.
The beginning will be the hardest but you will "kind of" get used to it.
FIGHT,FIGHT FIGHT.
You are innocent don't stop believing in it.
Keep faith.
You must try to afford legal aid.When you think about the worse money becomes only a tool.

Is it possible for cases to be thrown out of court? If so at what point would that be???

If you read through the threads you'll find that cases are thrown out prior to trial and during the course of.

Hopefully you will find a good sol and barrister in your area, I don't know of any reputable sols where you are but that does not mean they do not exist. Adrian Langdale is a good barrister who works in the local courts there.

Where is Mr Langdale exactly?

I was assured I was in good hands during my initial legal advice, but someone else will be at Magistrates and poss someone else at Crown??

There are other barristers who could do the job just as well. I have seen him in action though and he is very approachable which means a lot.

Are you happy with the sols you already had at interview? If not then hopefully others on here from your area may be able to help you. The Johnson Partnership (solicitors) in Nottingham are supposed to be good but there have been complaints that they do not keep the client up to date and fail to answer emails etc, - but they seem to come up with the goods at the end.

Please tell your family - imagine how they will feel if they find out through a newspaper report - it would be twice as bad for them.

I had the enviable job of phoning my ex-inlaws up and telling them, double bad as we hadn't spoken for two years!

Your parents will be gutted to think that you didn't trust them enough to tell them and that you'd gone through all this hell on your own. You think you are sparing them, but in the long run you're not - besides which you need them.
