I am wondering if someone has experenced this, He is at the moment on remand, has been for a good few months, he was working in a job he had for 4+ years, if he is found not guilty, Will he have lost his job? does he have any rights of geting his job back loss of wages etc?
Employment law is very much different to criminal law and works on a balance of probability. many people find themselves dismissed after they are charged.
He is fairly lucky that his work still keep him on now. I'd say if they have stood by him this long then if he is found not guilty, he'd have a decent chance of getting back to his work.
i dont think he has the job as he has been in prison for so long, it seems so unfair people lose everything and if they are found not guilty no one cares about them
Yes, unfair indeed but if you look at it from his employer's perspective, an employee isn't a great lot of use to them behind bars.
If he is found to be not guilty, he may be able to approach his work and they may offer to give him good references. Nothing to stop him then going on to seek employment elsewhere.
If a vacancy came up, his old work may even consider an application from him. No reason why not if he is acquitted.
