    Hi There
    My son has been accused of rape by his partner who he has been living with for over a year, during this time he has lived with her their life together has been turbulent...due to the interference by her parents and x-partner, on many occasions she has attempted to commit suicide, writing suicide notes (which my son currently holds) drinks heavily and has an unstable mind
    She has 3 children from her x-partner and is expecting very soon a child by my son.
    3 months ago she accused him of raping her, she decided not to deem this time was rape... just an over sexual desire to which she was awre of.
    Just recently on valentine night she once again accused him of rape whilst she was asleep (bear in mind she is soon to give birth...a few weeks) and has reported it to the police, consequently he had been arrested and let out on bail pending current inquiries.
    My son loves this girl so much when she rings him either at work or at his accomodation... he was with her immediatly to provide her with comfort, this dedication to her has probably lost him his job and his ability to come to terms with this horrible accusation.
    She has provide her x-partner as a material witness to the rape, how on gods earth can he be a witness if he wasnt there.
    It would be appeciated if someone can give some guidence on this issue.

    Hi and welcome, sorry that you find yourself here. Please ignore the title in bold...it is to ask a moderator to move it to our section for false allegations for rape.

    It sounds like the woman you are dealing with is very dangerous and your son must be going through hell, as must you.
    Did he have a solicitor present at interview? Your first important task is finding a solicitor who specialises in false accusations of a sexual nature.

    I can't really answer why this other man is being used as a witness but can say that a witness does not necessarily have to see the crime...but can attest to other things such as other actions from your son that might have indicated he was threatening to the accuser.
    Basically a 'witness' is anyone that can give any information at all that is relevant...not necessarily someone who has witnessed the alleged offence.

      Yes he had a sol with him, took the police 4 hrs to contact sol.
      The sol seemed to be amused at the accusers allegations I'm not sure if thats good or bad.
      My son is on bail presumably unconditional untill March, would that be an indicator that could lead to a NFA?

        Was this a duty solicitor? That's very typical of the police to drag their feet. I assume your son was plonked in a cell for this time. It's a very common tactic...it was probably done to make your son more frightened and emotional and unsure.
        Not a nice experience. Did your son answer questions, give a statement or go no comment?

        If the solicitor was a duty solicitor but is not specialised in these cases, you would need to find one who is. His solicitor seems to think the allegations are fightable although I'm sure your son didn't find them 'amusing'!

        Having unconditional bail doesn't mean much, it just means he isn't considered a danger to the public or any witnesses. The fact his bail seems so short however, could be cautiously perceived as a positive. Sometimes people can be bailed for months upon months.

            Sorry, I've just come away from writing a really formal letter and I'm stuck in the overly show-offy vocab!

            Basically, the fact that bail is so short seems like a good thing. I say cautiously as it's not a good idea to get your hopes up too much but GENERALLY the fact that it is so short may well be a good thing.

              It may be that she phoned him (or said she did) immediately after the alleged offence thus making it a 'recent complaint' and therefore admissible as evidence.

                Hi and welcome

                I'm a mum of an accused son. We too know the accusers

                My son has been bailed I'm sure 3 times now since last September

                We had to attend first bail but didn't need duty solicitor but others have been verbal

                Because we are still waiting for CPS to decide we don't have a solicitor (just the duty one)
                If we get a FA, then we'll be straight out looking

                My heart goes out to you and your son

                  This is an update on some of the info i gave you which was incorrect....sorry.
                  My son is on conditional bail not unconditional.
                  His bail time is until April not March.
                  This I presume throws a different light on the matter?

                    What are the conditions of his bail? Just not to contact the accuser? That's normal.
                    The bail sounds more standard but it doesn't necessarily throw a bad light on it.
                    Anything could happen. Just use this time positively to build a defence yourselves in case it is ever needed.

                      Another update on a development
                      My sons accuser has made contact with him, telling him she will not be making a statement against him.
                      Has this contact put his bail in jeapody?
                      Our problem at the moment is her family and her x-partner, they are the ones who have made the accusation, at the moment we have no concrete evidence with this, but all the worms seem to be coming to the surface.

                        Make sure your son does not engage in conversations with the accuser.
                        Take care that she might be playing games and luring him into a false sense of security.

                        if she retracts her statement obviously the case will be significantly weakened but be prepared that it may not necessarily be dropped.

                        His bail conditions would only be broken if he contacted her or maintained contact after she contacted him. get a copy of the phone bill to show who contacted who.

                          "Good news" we got an NFA, reason being the accuser was not my sons partner...it was her x-partner, when she had her interview she dropped all charge allegations.
                          She told the police that her x-partner had stolen her phone and other items to incriminate my son... she was then asked by the police if she wanted to prosecute her x-partner, dont know the outcome of that yet. Seems like the x wants to cause trouble!

                          PS I will keep you informed of future developments when my son gets his bail lifted.

                            Congratulations.

                            Seems to me if she has dropped the allegation then your son may be entitled to a No Crime rather than NFA
