  • arrested for indecent assult on 16 yo boy in jail

    i am a 22 year old male, the police came to the door 3 days ago and arressted me for indecent assult as allegations had been made against me. it had been alledged that 3-4 years ago i indecently assulted a 13 year old boy on two seperate occasions, this was when i was 18/19.

    The boy who is now 16 is serving a life sentance for the double rape of a 13 year old girl, robbery and GBH. he made this alligation from inside the young offenders prison. i have been interview and taped and have pleeded not guilty. This is not the first time he has made alligations about me, but they have never gone as far as the police, he has a disklike for me when he found out i was gay, i have told the police everything.

    i havent been in trouble with the police before so i dont no the prosess, i have been bailed to return to the police station in 7 weeks, i havent told anyone as i am scared and not sure what to do, i didnt have a solicitor in the interview as i didnt think i needed one at the time.

    it is his word against mine and there are no witnesses and the is no forensic evidents as it never happend, he also is on a life sentance and doesnt have parole for 4 years, i dont no if he thinks by making this alligation against me it is somehow providing him with a reason for what he has done.

    I have added the link of his case and news report, i dont no how someone making an alligation from inside makes any difference? when i go back to the police station, will there be a possibility of them dropping the charges there and then due to no evidence. if you can help answer any the simplest questions please do. As you will see from the link below Daniel is an evil boy and i hope if it goes any further that what he has done will become evidence.

    I can't really answer your questions, but I think you should just try and get the best legal advice you can. There's an organisation who help people who've been falsely accused who could advise you on what to do, and on finding good solicitors: FASO (False Allegations Support Organisation).

      I fully appreciate that this is a very worrying situation for you, there is nothing worse than a sexual assault except being falsely accused of it. The advice that you should immediately engage specialist legal advice is the best advice there is.

      Having read your post and the attachments I can have a pretty educated guess what is going on here.

      This evil ******* is working the head towards his parole and attempting to mitigate his deviant behaviour by alleging he was the victim of sexual assault.

      I don't want to give you false hope but I truly believe that the relevant authorities will take this no further. Your accuser can hardly be viewed as a credible witness.

      Cold comfort while you are awaiting answering your bail to return to the police station but in the meantime do engage a good solicitor.

        Like Ashley, I don't want to give you false hope, but in cases like these, where the "evidence" is one person's word against the other, the credibility of the witnesses is pivotal.

        Your accuser is in jail serving a life sentence for rape, assault and false imprisonment.
        You have never been in trouble with the police before.

        I would say that your testimony is likely to be viewed as far more credible than his. However, this is a mad world. Definitely get some specialist legal advice, and protect yourself as well as possible.
