My partner has just been wrongfully convicted of rape. We had one trial in August which which had a hung jury. Then the second trial finished on Thursday with a guilty verdict.
All the way though I assumed everything would be ok as I thought there was no way a jury could come back with a guilty verdict when it was simply her word against his. I am completly in shock and devestated. I wish I had found this website earlier as I now feel there is so much more I could have done. The barrister didnt call some potential witnesses because he said it was not for him to prove his innocence but for the prosecution to prove his guilt. I wasnt happy about this at the time but ultimatly trusted the barrister that he knew what he was talking about.
The girl has cried rape on two previous occassions one of which she got £11,000 compensation and the other didnt go to court. She has also said she has been kidnapped.
My partner got 5 years and he was taken straight away. I have spoken to the solicitor who said there are no grounds for appeal, but I dont feel like I can just sit here and do nothing, I cant believe it can be so easy for an innocent man to go to prison. What can I do now?

    Hi,

From what you say your partner's conviction was unfortunate to say the least!

The barrister's comments were a little naive & idealistic; possibly he wasn't experienced in defending sexual offences.

I can't give much advice about appeals but I would suggest you get a second opinion at the very least, as the original defence team are not likely to admit they have screwed up. There are some members who have experience in this field; hopefully they will see your post and respond with further advice.

ID123 take a look at my signature and check out the website of the solicitor concerned. You'll see he specialises in false allegations of rape cases.

Just because Counsel and sol says there are not grounds with which to appeal does not mean that there are none. Most of the successful appeals I have been involved with the guy was told there were no grounds......

hi i think the fact that the girl has 2 other previous accusations of rape tell me she is a serial accuser. and i think that could possibly go against her if you are trying for appeal. she can.t go on accusing people of rape and get away with it . why didn.t the defence team pick up on this .surely she is not that unlucky to get raped 3 times

The jury were only told about one 'rape' because the other one didnt go to court. Hopefully it could hep in an appeal though if a judge could see all the facts.
