      The obvious answer is as soon as possible but of course it's never as easy as that!

      Whilst you can collect and collate as much relevant information as possible your solicitor can't really build this up into a defence statement until they seen all the prosecution material especially the accuser's statement.

      The usual explanation for delays in handing over the CPS bundle is pressure of work but I suspect an element of gamesmanship comes into play; after all, the later the paperwork is handed over, the less time the defence has to work on their statement.

      Of course this works both ways; the prosecution then will also see the defence statement late and may not have time to run it past their witnesses.

      This sounds quite promising: If the friend's statement about what the accuser told her in the phone call made immediately after the alleged offence gives a substantially different account to that which the accuser will make in the witness box (or in the video evidence, whichever applies) your barrister will be able to cross-examine her on the reasons for this, thus hopefully giving the implication to the jury that she was adding to her story as time went on.

      On the other hand she may simply say that she was too traumatised at the time to tell her friend everything!

        Defence Case Statement (DCS) can be done right from the beginning of procedures (after charge) - never a good idea as you don't know exactly what you are facing.

        It should only be done once all disclosure has been obtained and scrutinised.

        It should not show the whole of the defence otherwise you are allowing the Crown to see all you cards (strategy).

          I am using her for my case and she seems great doesnt she ?

          • Yes I'm using Nerida and she seems very experienced. The liar called her friend as soon as it allegedly happened gave a diffrent account and even when they caught up week later was still a diffrent account given

            • I'm starting to feel depressed and suicidal again, I got three months till

              Trial I'm scared and thinking of taking loads of sleeping pills to end all this rubbish.

              I got a message for another confrence with counsel, is this normal? They said they need to go over some things for defence statement to clarify issues.

              I'm tired and just want out of everything

                    Please,believe!!! I have been through this .Please pm me if you need,I will always be there.
                    If you are desperate for a barrister I will give you mine ,he is 40 years experienced in bombs,drugs,rape,tax,money,...,and he saved me.He is in London.
                    Call the samaritans,sometimes they feel more depress than you,so switch off and you will get another one,try your family and I would even give you a temporary one if you understand but please DAKI!!!

                    • Daki you have to keep fighting domt give up for anything. Remember we are all here with you as well and no doubt hundreds more of your friends. Just try and keep your head up and fight a bit more your nearly there now.

                            • Daki, have you got a nominated person who you feel this way?
                              And have you considered visiting your GP? Suicidal thoughts are often born out of depression or serious events in life which we become unable to cope with. I'd imagine it's a little of both for you.

                              There have been two significant spells in my life where I have been strongly suicidal. In fact, once I carried an attempt through but thankfully it was unsuccessful (obviously)

                              Suicide is a cry for help...but when people say that it does not mean that a person is simply doing it for attention. In most cases, that is not the scenario. It is a very serious indication that something is badly wrong and that this person needs help NOW

                              You made it through a very tough night. I am so very proud of you for doing that...it makes you strong and it implies to me that there is a lingering doubt in you about killing yourself. Thank God for that. Times will get better but you will hit lows again. And when that happens, do what you did last night. Post on here. Email someone. PM someone. Make a phone call. Do anything or do it all. And when those thoughts come, do yourself and everyone else the justice of allowing it to be talked about first.

                              You will not be judged by anybody here. Chances are, a large proportion of our members have been where you are at the moment. They have come out the other end and you can and WILL too.

                              Please, please make use of the offers of help. Like the website Rights Fighter provided says, often you just need a few more resources to balance out the overwhelming pain. Let us be the resources.

                                I assume you have family, don't do it to them

                                I was like that once, I sobbed to a friend who got me to live at hers, there and then that night, I know she saved my life

                                When you pull through those moments, you really realise that it would've been the most wrong thing to do

                                Everything daki, and I mean everything is mendable in life
