  • son's trial coninues

Hi just thought I would let you all no how things are going for my son. The jury are still out so its back to court tomorrow. The jury went out at 11am and still hadn't reached a verdit by 4pm so the judge has carried on till tomorrow.
My son's barrister wanted the original charge to stand as it is and not change it as the jury had asked the judge. So the agony continues again tomorrow. We just want this over with now and his barrister said that they will have to reach a verdit tomorrow. I shall keep you all posted tomorrow. Thank you for all your support. x

It's a good sign, because it doesn't sound like the jury believe his accuser's account. Meaning they'll likely acquit him of it.
Hang in there. Thinking of you.

That's what we thought esp when the jury came back to question one of her lies! they were out from 11.30 sent home at 4 then they had reached their unanimous verdict by 11 next day?? didn't make sense, like i said though Janerose hoping it's different for you, it is another group of people at the end of the day so nobody can say, fingers crossed for you again x

I am keeping my fingers crossed for you, good luck, they say that no news is good news. We waited for 2 days before they came back with a majority not guilty verdict, the judge was not pleased as he was very biased in his summing up.

WF the judge was very one sided in his summing up of hubbys case too!! are they allowed to do this it can't be classed as a fair trail surely?! i have no doubt if it had been left to closing statements we wouldn't be here now, her barrister looked defeated after he did his closing statement because they had nothing and she had messed up! then the judge did his long summary and felt like he brushed over her lies and made excuses for her, he should have stood for her!! he went over hubbys very quickly and questioned my hubbys answers.

Thinking of you again Janerose xx

our judge too made a one sided argument in her favour.. [quote] just because she lied about where she met him or how long she had known him . doesn't mean she deliberately lied you could put that down to trauma .. and just because she stated on 2 separate interviews she told them different version on what she was wearing .on statement one she was wearing trousers.on statement 2 she was wearing a skirt and
tights means she was also in trauma . and just because she lied about telling her best friend and brother just after the incident when in fact she never. you could also put that down to trauma . WHAAAAAAAT .. he also in his summing up said something that made me mad . i made a tutting sound in court when he said it and was cautioned by the court usher.. he said just because she never showed the bruises on her hips and wrists .[ my son must have 4 hands ] to her friend till december doesn't mean she was lying about the bruises being red but they would have probably been yellow ...... what after 3 months nobody even my barrister never even questioned the bruise factor iv never in my life had bruises that are yellow 3 months afterwards ..

I am assuming this must have been hearsay evidence the judge was reviewing - in which case this could be a misdirection and potentially a ground with which to appeal. Have you contacted an appeals solicitor who is experienced in these cases?

                              hi RF
is your post addressed to me . if so yes we are appealing just waiting for new solicitor to get through transcripts from court i hope the judges summing up speeches in thier as well thanks the barrister in his written advice of appeal did mention these facts of the bruises but said it would not have made any difference to the outcome . but is it correct that if her friend said she saw bruises that this is hearsay..
