My partner was asked to give a statement

Can you tell me if this is legal,i recently had to surrender to bail,my partner came with me,as i was entering the police cell area,i was told my bail would be extended,i was then asked if my partner would give a statement to the cid who was handling the case,
i said i don`t know,and that she would have to ask her herself,anyway my partner gave a statement to her saying she would stand up in court for me,however this statement was not taped,is this the norm?

It wouldn't be taped if it was just a statement, but they may have been trying to make sure that she couldn't be used as a witness for you instead they could use her as a witness for the prosecution.

thank you for your swift reply its much appreciated,so have i been duped by the cid?how can they use her as a witness when she has made it clear that she will stand up in court for me,also i have an alegation made against me 3 years and 7 and a half months ago,yes its taken the police 3 years to drive across town to arrest me,and i have been on unconditional bail for 7 and a half months,and still not charged,i am really getting ill with all this,also the police told me to take my time in going down to the police HQ as i was not in when they came,i made my statement without a solicitor answered ever question open and honestly,however the cid said before the tape was put on that,i could just say no comment if i wanted to all the questions,but i declined as this gave me a feeling they may interprit this as guilt!

If they decide by something that she's said that can be twisted and used against you - they will. I wouldn't start worrying yet though as they seem to be taking their time.

I'm not sure that there may be a time limit on these things - when RF comes along I'm sure she'll be able to answer it. Over three years does seem excessive.

Make sure that you have a solicitor that has knowledge and experience of these types of cases if they want to question you again. Your answers should be short without going into detail, again anything you say will be taken down and may be twisted.

Never EVER be interviewed without a solicitor present.

You have not been duped by the police/CPS in that they wanted to take a statement forum your partner. Happens all the time. This won't stop her talking to your solicitor and producing a suitable statement for your barrister to work from should the matter proceed.

Without further details relating to the allegation over three years ago I can't comment on how "legal" it may be. You are better asking a solicitor that question IF you are charged........or IF you are reinterviewed before which you then instruct a solicitor to attend with you.

Nope but had a swim in the pool and the steam room was great for my little old lady lungs..........had an Asthma attack during one night...........just what I needed! Back home now so playing catch-up.....
