  • False Historic Allegation 15yrs ago!! How can i prove its fasle

Hi Everyone, i dont know really where to start but i shall try, i was sitting at home on Monday morning and got a phone call from my Professional Standards Dept, I am a serving Police Officer, they said they wanted to question me in relation to a historic criminal allegation but would not mention the offence, date, Ip or any other details, just said i would find out as soon as i could get there..... i could not go straight away as i needed to sort out legal advice etc and the earliest both i and the investigator could do was Wednesday, so Wednesday after two nights of no sleep, no food and generally feeling s*it i turned up to be greated by people i knew to interview me, disclosure was given and then it hit me when i read the form, Historic Rape!!! The IP, the mother of my son who is 16yrs old. Have now been interviewed, no other statements were disclosed but that does not mean there is no others, case now off to CPS, dont trust them as to be transparent they often have to put Officers in the dock!!!! I know i am innocent, i know i have not done anything and i know why this is being said. I just hope i can prove it!!!!!! Thanks to who ever has a quick read of this, i just needed to write it somewhere.

She's taken her time in reporting it. She's not a child and wasn't one when it allegedly happened so she can't use the excuse that she was "scared". She's going to need a good reason as to why she did not disclose when you split up (I take it you have split up? If not then there will be further questions as to why she stayed with you for so long with no complaint) - when it was "safe" to do so.

I've been helping to review trial paperwork for appeals against conviction for several years and I have yet to come across one in circumstances you describe.

          Rf -

We split late 1995 this was meant to have happened in early 1996, i did not go to the house after the split except for once when i was with someone else (who may or may not remember that i did not go into the house) i was stopped contact with my son by my ex until she moved out of the area, during that time we went to court and i got PR for my son but contact was not contested and the District Judge told us to go to mediation to sort it out. There was no mention of any violence on the statement of interest filed with the court by either party.... Ex moved out the area and for the last 15yrs i have been visiting there to collect my son and drop him off, most times on my own with no one else in the house.

I am pretty sure i know why she has made the allegation, but its such a worry to try and disprove it happened, i am not confident in the legal system and i work with it!!!!!!

So she will have to come up with a damn good reason as to why she has only decided to make the allegation now.

Motive is extremely important in defending these allegations - possibly she is short of money and could use a quick £16K? That's roughly what she might receive from the tax-payer's shopping list aka CICA = Criminal Injuries Compensation Authority.

Clearly the split was acrimonious as there was the issue of contact with your son so resentment stemming back years.

You might know that if you provide alibi evidence the OIC might go back to the complainant who will then "remember" it as being another date, or may not remember the date at all........
