    Not necessarily true. For example, RIM's Blackberry does not store information on the phone. In fact it's not even stored in the country of use; it's stored on RIM's servers in the US.
    Meaning getting the information out of them is going to be hard to impossible, as they don't have any obligation to do as you ask, and even UK court orders are not enforceable.

    I had exactly the same problem vis Hotmail when MSN Messenger information was required for my defence, and we lost out because there was no way to force Hotmail to hand it over.

    Also, bear in mind saving voicemails doesn't mean they're kept either. Many phone companies delete them after seven days.

    Treat everything on your phone as volatile and fragile unless you make a separate copy like a photo or screenshot and store it off that phone.

      hi my phone is a blackberry 8520. and you said could my husband have deleted it the answer is no he never goes near my phone and the text was for his benefit. on my phone it still says the time date of the text and who off just no text in there.

        Okay, well being a Blackberry there'll be little way of you getting the original message off.
        The fact the text isn't there - even tho the sender is - could be something to do with RIM.
        That said, I've had emails off one little sh1t who sent me 28 emails in one night from an email addy that couldn't be identified, ie a dead end.
        Could your text be along similar lines - designed to self-delete after x number of days.
        As said, could still be due to Blackberry themselves.

          magistrates court

          my hubby goes to magistrates ciurt tomorrow afternoon. i hope it doesnt go in the paper but knowing our luck lately im sure it will.
          can anyone tell me when we will get a copy of the other statements will it be a few days after this.

            Having hunted for your posts, and worked out that it must be a procedural hearing on the way to Crown Court, I'd say paperwork will be weeks away.

              sorry he has been charged with so with penetration (finger)so he basically going here so they can say they cant deal with it he doesnt have to plea or anything

                Right, so it's going to Crown Court and isn't a hearing for which paperwork is dependent.
                Therefore, you have no need to worry about paperwork not showing up just yet. You'll find it coming in dribs and drabs, and often via your solicitor.

                  oh really i thought we would get it soon so we could see the lies she is saying, oh just more waiting then, if any of these legalm mpeople had to go through a false allegation im sure they would speed things up. the waiting and not knowing is so painful and agonising

                      Although the case is about your hubby, he is not in charge of it, and unfortunately he is somewhat down the pecking order when it comes to paperwork.

                      Remember the system works slowly, but paperwork will arrive. At the moment you're in the early start of the trial process, and I would only start worrying if you haven't received the paperwork by the month before the trial.

                      Usually it's received long before that, but it's not something you can pin down to a set date.

                        One thing to remember re time is that all handwritten statements have to be physically typed up, which adds to the delay.

                            The trial I was recently involved with - paperwork started to come through once it had gone to Mag court and more so after committal. But then that a solicitor who pushes and pushes for disclosure. Not all are like that unfortunately.
