    shocked thank you for reply is his case over now i dont know how you found the strenghth but glad you did how are your children now.

    only just found this site at least i know now that iam not on on my own did not realise how many false accusations are made

      It really depends on the circumstances. I attended a trial in Coventry last year to support a client and his family, and after our QC argued with the judge and said judge realised he could not defeat her, ordered that the Crown should get a QC rather then the junior that was present.

      It was the QC for the Crown who decided to drop the matter and offered no evidence.

      I have to say though, that this is the exception rather than the norm.

      Once we can make contact scared wife, I'll hopefully be able to support you privately. This is "my type of case" and have been assisting in them for ten years now.

          When the girl went to police but the didnot talk to him after 3 months later is this normal don't know what my husband going to has it was so long ago and a lot of poeple around at the time that know them all he as lost touch I feel so hopeless that can't help him and feel that I am not there for him because off this I keep thinking it is.a dream and I will wake up soon

            heard nothing from the embassy yet about the date my was out of the country we are talking and feeling a little better family have reccomended we try to get character witnesses.

            we are trying to find people who was freinds at the time but its so long ago would character witnesses who was not around at the time but have known us for a number of years still be of use we could probably get quite a few how many will the court read ? many thanks scared wife

              I seem to remember reading of one case where the accused had literally dozens of character references and all were read by the judge.
              My husband had about 14.
              I don't think they have to be from people who knew him at the time (although that is helpful) but people who have known him for several years would be good.

              Hang in there. You will find the strength. You never know what you can cope with until you have to cope with it.

                Can I ask, when you're talking about character refs for court, are these just written statements from people - that is, do the people who give the references have to appear in court?

                    been feeling down for last couple days heard nothing from the embessy struggling to find old freinds from over 20yrs ago she has a couple of witnesses blackening our name we have none how do we aproach people for character reffrences without them thinking no smoke without fire. all this becuase of one persons lies. the wall seems to be getting higher and i dont know how to cilmb it.

                      The embassy will take a while to respond - they deal with a huge number of queries every day, so try not to worry about it.
                      If two people are trying to blacken Hubby's name, then go through what they are saying. Isolate the lies/implications from the facts, then pass this to your sol. Have they said this in their statements, or to the public at large?
                      Have other people told you what these two people are saying, or have you heard it 'from the "horse's mouth?" are they telling lies, or implying that he is a bad man? If they are telling lies: are they provable lies? is anyone prepared to stand up in court and categorically state that what these two people are saying is False?

                      Sorry for all the questions, but his could be helpful to your hubby's case so it's important you investigate. If they are attempting a smear campaign, you need to get proof (in the form of statements/witnesses) that this is what they are trying to do.

                        once again saffron thanks for your replies its difficult to describe without publishing all the facts on a public forum its more of an exageration of facts which give a little credit to accusers story i will try to give an example but has nothing to do with case

                        ian can be moody and has had 1 fight and admits it in a statement to his defence

                        prosucuter witness states ian his moody and violant implying he is more violant than the one fight and therefor victim is very scared

                        so not telling lies as such but a big exageration of the facts

                        not sure it makes sense sorry if it doesent cant wait untill i can pm so that i can explain myself better

                          This is par for the course I'm afraid. The witnesses will have been interviewed by Plod, and Plod's questions would have been something like this:
                          Officer: "has Mr X ever been violent?"
                          Witness: "No, I don't think so"
                          Officer: "Are you sure? He's never been in a fight?"
                          Witness: "well, he did get into a fight once"
                          Officer: "So he is violent then. Has he ever been bad-tempered?"
                          Witness: "only when he's provoked, but everyone gets a bit moody now and then, when they are riled."
                          Officer: "So he has got a temper then"

                          And so on. I am sure you see where I am coming from. As RFLH has said elsewhere on the forum, welcome to the horrible world of having your words twisted to suit those asking the questions. A good barrister should be able to turn this around at trial.

                          You will be able to PM soon. We had to put the PM controls in place because we were getting a lot of people coming here and asking for help and advice without actually making a post. This became rather irksome, especially for us Mods, as we give our time for free and in good faith. Often people would ask us for advice via a PM, get the advice, and then we would never hear from them again. Whilst us Mods and members are generally happy to give advice, we are also trying to run a help & support forum - we are not qualified to give free legal advice. This means that members should contribute to the forum as well as gain from it. In addition, by posting their stories, people gain far more support than they would from a simple PM sent to a single person.

                          I am not directing any of this at you, far from it! I am just trying to explain why you can't send PMs until the qualifying peroid has been reached.

                            saffron we are both gratefull for honest opionens and people good enough to to put there experiances on here both good and bad.
                            i fully understand the reasons for the pm rules
                            we will post our experiances has things progress and hope it helps others i may sound negative at times but has you people on here know things can go horribly wrong
                            we will fight to the end but if it does go wrong we are almost certain to lose our home which we have just bought ( depending on length of sentance ) so you can see why iam extra worried.

                              Hi Scared Wife. For some reason you cannot be private messaged - maybe you can check your profile settings so I can contact you direct?

                              Re character references: These can help especially at sentence if conviction occurs. There are certain ways these references should be worded without pis*ing off the judge.

                              Good character references do not prove the alleged assaults did not take place and they are not evidence of innocence.

                              If hubby has never been in trouble with the police before or if he has, and it is completely unrelated to the type of offence of the current matters, then the judge must give the jury a "Good Character Direction" when summing up the evidence.

                              As I said though, it proves nothing.

                                thanks for reply rights fighter no hubby has never been in any trouble before with the exception of a couple of minor driving offences speeding etc he holds a firearns certificate which as you will be aware these are not given lightly. i understand character witness cannot prove innocence but may show the judge he is not the bad temperd violant person the accused family is saying he is i will also check my profile
