    Then when the police left her flat, she switched off the phone and give her friends to keep it for few months until last few weeks when she is checking messages etc.

    If she hide it the phone from the police then she will be in big trouble if I can prove it in the court.

      If you are charged, your solicitor will get to see the prosecution's evidence. From this you should be able to see if the police have downloaded the texts from the woman's mobile; you can then work out a suitable defence based around these texts.
