    Ammendment for Saffron.

    As an ammendment to my last thread i wrote i have never pleaded guilty to an offence. What i meant to write was i have not once pleaded not guilty to an offence, i just wanted to clear that up.

      Hi Saffron.

      No i dont mind you asking about my criminal background, i have nothing to hide and as i have allready stated i have been battling drug addiction for over 30 years so it may come as no suprise that all of my previous convictions have been for dishonesty in relation to stealing to obtain money to buy drugs. Whilst this may raise some eyebrows in relation to wheather i am now being honest i dont really care, even in a court to a jury, i do understand that this may prejudice my case but i am not ashamed of my past, it has been a battle and is a wonder i am still here. I have been to court over 30 times and not once pleaded guilty to an offence but rather choosing to take responsibility for my actions. I have done a lot of rehabilitation at various places over the years and was given a whole new set of skills and tools from which to live my life by, one of them was Honesty and i whole heartedly stand by that value as the mainstay of humanity (laugh if you will) but without this fundamental word the world in which we live falls apart and is one of the reasons why it is in such a mess, it is a plague within todays society. Because i have had issues with addiction doesnt mean i am a rapist, allthough i do understand that the way in which juries work may in fact means that this may happen.

        Committing drug related offences does not make you a paedophile or rapist, Bez.

        The fact that you pleaded guilty at the earliest opportunity and then went on to do offence-related coursework should go in your favour.

          Hi Bez

          Thanks for your honesty, it really is much appreciated.
          Any previous offences should not be admissible....they are not of a "similar" nature to the current accusations. However, the CPS may try to use previous convictions to "blacken" your character....ie...."Look your Honour, he's a [albeit reformed] drug addict, how can we trust anything he says?"
          Your legal team should be able to explain to you how they are planning to defend this. If they can't explain it, you need to think about changing your legal team, (if you can).

            Unfortunately sometimes the previous is put regardless of how irrelevant they are.

            If this happens then the barrister (if it goes to trial) MUST make it clear to the jury that Bez did not hesitate to plead guilty on those charges and that he worked to improve himself while he was away.

            As I said, it can actually work in his favour.

              Thanks again.

              For the support, personally, and im sure you will not agree with me but i want a jury to know the truth because if i do go to trial then isnt that what its meant to be about, the truth. This is what i mean about the mess the world is in, the truth no matter how it looks should be told, and if i have to hide from the truth to strengthen my case then it shows what a mockery the justice system really is, its like point scoring with a persons life, if you win enough points you get a cuddly toy and your freedom. SHAMBLES !!!!!!!!!!!

                No one can blame you for being angry. There are so many different things going on for you to be angry about. I hate the way they 'feed into the mother' or sister in my case when my brother was accused. And yes, they are good at it it, I even questioned his innocence for a second there! Only for a second mind you.
                And I agree about the miscarriages of justice, I have read so many books this year relating to them. It does happen & will keep on happening.
                But lets hope n pray that it wont come to that with you.
                People on here have been rebailed a couple of times before having no further action. So dont think the worst there. My brother was accused of sexual assult, was rebailed about 3 or 4 times, he did get charged & it ended up in court, which was postponed on day one for another few months because another witness came up. Then it was thrown out of court. He didn't even get to give his evidence, so it can stop at any point.
                Heart goes out to you though & I dont really have any advice about finding strength, as I haven't been in your shoes. I just hope you can find strength x

                  Been in a dark place there for a few days. Got in touch with police to find out if they are going to charge me or not and she couldnt say or rather didnt want to, but her demenour has definately changed, at interview it was hi Bez how are you Bez dont be nervous Bez, and now its gone to hard face dont phone againMr T, I didnt say that Mr T. just by her attittude i think i will now be charged. I am Sh...ing myself. The police have been investigating me for a while and have turned a community against me, ALL my so called friends have deserted me, even my ex wife, partner was with me while speaking to them. My life has really fallen apart and i dont even know where i am going to get the strength to get through this. All my support has gone, probably what they wanted, i cant believe peoples attittudes, people who i thought were friends, i have got no one, nothing left. What is the point ? it would be so much easier to give in, i dont think i will get through a court case where, especially one of rape by my own family. Im just hanging by a thread and am really sorry to people visiting this site for the first time that i havent anything positive to say or any good advice to give, so please forgive me for my self pitty.

                    Can my ex wife be made by my solicitor to give evidence for me if she doesnt want to ? or anyone for that matter ? because i think the evidence she has is important for my case but she says she wont go to court.

                      I think witnesses can be subpoenad to attend.
                      Hang in there Bez. You don't know for definite that you are going to be charged.

                            Unfortunately not. I have recently assisted with an appeal where the defendant took a lie detector test (it was done by the guy who exmined Colin Stagg after the Rachel Nickell murder several years ago).

                            The result was that he had not sexually abused his daughter.

                            When he went into the witness box to give evidence he attempted to show the jury the results even though he had already been told that this evidence was inadmissible. The judge laughted at him in front of the jury saying "you have wasted a lot of money Mr X".


                            Oddly enough, lie detectors are allowed once an inmate has been released from prison to check he has not been misbehaving. It's amazing that they are considered to be reliable enough for that but not pre-trial.
